This Act makes provision for real property rights in relation with common property in condominium. This Act shall apply only to property as hereinafter defined which is expressly made subject to the provisions of this Act by a Declaration, i.e. an instrument duly executed under seal by the person or persons having the legal and equitable title in fee simple absolute to the property to which the Declaration relates. The Act defines the contents of such a Declaration and the effects of the registration of a Declaration with the Registry of Records of The Bahamas.The Act furthermore, among other things: defines the undivided share of each unit owner in the common property; requires certain particulars to be included in a deed of unit; concerns easements and relative ancillary rights and obligations, defines contents of bylaws that may be made by board of management of the body corporate that operates a common property, makes provisions with respect to services regarding units in the common property and provides with respect to mortgages.
