This Law provides the general conditions and manner of protection and conservation of nature, which as a group of environmental and natural resources and assets enjoys full protection within the territory of Montenegro.The text of the Law is divided into XVI Chapters as follows: General provisions (I); Subjects of nature protection (II); Nature protection documents (III); Nature protection and preservation (IV); Protected natural resources (V); Management of protected areas and of environment network areas (VI); Speleological, geological and paleontological sites (VII); Protection of wild species (VIII); Preservation of genetic diversity (IX); Monitoring over the state of nature (X); Access to information and promotion of nature protection (XI); Nature protection financing (XII); Preservation of protected natural resources; Supervision (XIV); Penalty provisions (XV); and Transitional and final provisions (XVI).As defined by this Law, the nature as concept its self is a unity of the geosphere and the biosphere, including all species of wild plants, animals, mushrooms and other natural resources that are distinguished by biological, geological, geomorphological and locational diversity. The Law provides for various issues closely defining the protection measure for many species, including particular wild birds electric fence protection issues (see article 116).The principal objectives of this Law are: preservation and improvement of biological diversity (genetic, ecosystem, also for species and alien species), geological and landscape diversity; preservation and improvement of individual natural assets; identification and monitoring of the state of nature; aligning human activities, economic and social development plans, programmes and projects with sustainable ones, that are using renewable and/or rational use of non-renewable natural values and resources (also as regards the fishing and hunting activities and preservation of wild animals and plant species); prevention of activities with adverse impacts on nature that are a consequence of economic growth; protection and preservation of cross-border valuable parts of nature and protected natural resources; preservation of natural properties of the land, quality, quantity and availability of water, including the quality/pollution issues as regards the sea water; to control all possibly harmful activities during various stages of commerce, transport and other other related actions; imposition of marking issues for all protected areas, species and varieties; establishment and imposition of necessary inspection requirements and tasks.Nature protection as a set of actions includes: protection of flora, fauna and geomorphological phenomena; proclamation of protected natural assets and their conservation and management, in order to preserve or improve the objectives of such protection measures and rules; protection of all endangered, rare and indigenous species; identification and assessment of the state of phenomena and processes in nature; direct implementation of nature protection measures; providing of guidelines and concrete conditions for nature protection in spatial planning documents, at all levels of development and regulatory plans, concession documents, development programmes and programmes for management of natural resources (mining, energy, transport, water management, agriculture, forestry, hunting, fishing, tourism and other activities of impacts on nature); conduction of continuous monitoring activities over the cumulative impacts on protected natural assets due to the implementation of interventions that have big or less important negative effects on nature; implementation of nature protection measures aimed at eliminating and mitigating adverse impacts on habitats and wild or domestic species; establishment of the system for managing such protected natural assets; linking and harmonizing the nature protection system with the international nature protection system and requirements, also in terms of data collection and necessary reporting and collaboration; encouragement of scientific and professional work in the field of nature protection; encouragement of sustainable valorization principle in ecosystem services; highlighting the importance and necessity of nature protection through the education system from pre-school education to University levels.However, the rules here stipulated will not be considered and will not apply in case of suppression and prevention of imminent danger to human life and health or danger that is imminent in relation with specific strategic properties or infrastructural assets (see article 5).
