Upper Austria Farmland Requirement Law 1979.

The present Law lays down provisions relating to conditions of farmland in Upper Austria. Article 1 deals with land consolidations. With a view to create and maintain an efficient and environment-friendly agriculture, property rights, rights of use and cultivation in rural life may be improved or newly arranged by means of : 1) new divisions and development of agricultural and forest land; 2) merging agricultural and forestry industries taking into account modern agricultural and ecological factors.

Upper Austria Soil Protection Law 1991.

The purpose of the present Law is to conserve and protect the soil against harmful effects, in particular against erosion, densification of the soil and hazardous substances, and to improve and restore the health of the soil. To reach this aim everyone shall behave in such a way as to reduce damage to the soil to the unavoidable minimum – in particular accumulation of hazardous substances in the soil and deterioration of the soil structure – in view of ensuring an effective soil protection.

Upper Austria Forest Land Division Law.

Article 1 of the above-mentioned Law establishes that the division of forest land as a result of which a remaining part of land would reach no longer the minimum size for forestry management is forbidden. The minimum size is 1 ha and a minimum width of 40 m. However, if the public interest prevails such divisions are permitted as, for instance, in case of water works, mining activities, energy resources, improvement of agricultural structure, land reform, and so on.
