Por medio de la presente Ley se declara emergencia pública ambiental en la superficie de la Cuenca El Morro y su área de Influencia, comprendida en el territorio de la provincia de San Luis, por el término de cinco años. El objetivo es mitigar y detener los procesos de erosión, agotamiento, degradación y desbalances hídricos del suelo de la cuenca, en el marco del derecho a un ambiente sano, equilibrado y apto para el desarrollo humano.

This Decree of the Ministry of Environment lays down detailed rules for the quality protection of agricultural land. The preventive values of hazardous substances in the agricultural land are set out in Annex 1. The indicative values of hazardous substances in agricultural land are set out in Annex 2. Determination of the contents of hazardous substances in agricultural land shall be carried out using the procedures is specified in Annex 3. The sampling procedure for determination of contents of hazardous substances in agricultural land is set out in Annex 4.

This Law 49/2016 amends articles 5, 7, 14, 24, 26, 29 and 31 of Law 9693 of 2007. The amendments concern the ownership of the pasture fund now divided into a) the state pasture fund consisting of the pasture and lawns owned by the municipality managing their territory; and b) the private pasture fund consisting of the pasture and lawns in private property.The line ministry is the responsible authority for the protection and administration of the pasture fund in the protected areas.

The absence of a clearly defined land use policy in Kenya after years of independence has resulted in a haphazard approach to managing the different land use practices and policy responses. Land use continues to be addressed through many uncoordinated legal and policy frameworks that have done little to unravel the many issues that affect land use management. The Constitution of Kenya 2010, Kenya Vision 2030 and the Sessional Paper No. 3 of 2009 on National Land Policy all call for a clear framework for effectively addressing the challenges related to land use.
