Aboriginal and Torres Strait Islander Heritage Protection Act 1984.

The purposes of this Act are the preservation and protection from injury or desecration of areas and objects in Australia and in Australian waters, being areas and objects that are of particular significance to Aboriginals in accordance with Aboriginal tradition.The Minister may, upon application made orally or in writing by or on behalf of an Aboriginal or a group of Aboriginals seeking the preservation or protection of a specified area from injury or desecration, make a declaration in relation to the area.

The object of this Act is to facilitate the subdivision of land into parcels for separate development or disposition: (a) with an interest in associated land in the nature of common or shared property, and (b) with or without further subdivision (including a subdivision under the Strata Schemes (Freehold Development) Act 1973) in conjunction with the development of another such parcel or other such parcels.

This Act provides for the management of community, precinct and neighbourhood schemes, for matters relating association property and for resolving of disputes relating to a community scheme. Part 2 concerns the constitution and management of associations incorporated under the Community Land Development Act, 1989.

Section 3 provides for the validation of invalid planning instruments. Any proceedings in any court (including the proceedings in relation to: (a) any of the planning instruments in so far as they apply to the relevant land (whether or not the instruments apply to any other land); (b) any development application, grant of consent or grant of concurrence referred to in section 3 (2); or (d) any associated matters in any court shall be terminated (sect. 4).
