The object of this Act is to facilitate the subdivision of land into parcels for separate development or disposition: (a) with an interest in associated land in the nature of common or shared property, and (b) with or without further subdivision (including a subdivision under the Strata Schemes (Freehold Development) Act 1973) in conjunction with the development of another such parcel or other such parcels. A plan is not registrable under this Act if, in the opinion of the Registrar-General, it is essentially for: (a) the subdivision of a building into lots, or into lots and common property, where the lots are, by reference to the building, made to correspond to attached or semi-detached units within the building (whether or not a lot includes land not within the building), or (b) the subdivision of land into lots and common property, where the common property comprises mainly land above a lot or lots or land below a lot or lots, or (c) the subdivision of land into lots limited wholly or partly in height or in depth. Land may be subdivided on the basis of community schemes, precinct schemes and neighbourhood schemes. The registration of schemes shall lead to the incorporation of respective associations.
