Order No. 213 of the Ministry of Justice validating the Regulation on the state registration of mortgage of immovable property.

This Order establishes common rules and procedures regarding the state registration of mortgage of immovable property, including plots of land. Mortgage can be established in accordance with contract on mortgage of the plots of land. Mortgage of the plots of land pertaining to the state or municipal property and of the plots of land with area less than minimum land area established by law shall be prohibited. Mortgage contract shall be concluded in writing and it shall enter into force after the official registration thereof.

Ministerial Decree No. 710 amending Ministerial Decree No. 219 regarding validation of the Regulation on keeping Common state register of immovable property and its transactions.

Item 39 shall be supplemented with the following wording: “In the process of state registration of land share of agricultural land calculation thereof can be done in hectares.” Item 61 shall be supplemented with a new paragraph specifying that in case of expropriation of land for public or municipal needs personal identification data of the owner of the plot of land and the beneficiary of expropriated land, Russian Federation, regional authority or municipal unit must be declared.

This Act provides rules relative to the establishment, management and termination of a condominium and provides for the registration of a condominium plan.Owners of land, which has been surveyed in accordance with the Land Survey Act and on which there is a building of more than one story or which consists of more residential units, may apply for the registration of a condominium plan. Such plan shall be drafted in accordance with requirements as set out by this Act. The Registrar General shall maintain a register of condominium plans.

This Law regulates activities in the sphere of geodesy and cartography including: (a) distant zoning of the earth; and (b) mapping and demarcation of the state frontier, administrative boundaries and plots of land pertaining to private ownership. The object of geodetic and cartographic activity shall be national territory. The State Agency of Land Relations and Cadastre shall carry out geodetic and cartographic activity, mapping, zoning and updating of land cadastre data.

La presente Ley crea el Bono de Formalización Inmobiliaria (BFI), que consiste en la ayuda económica directa no reembolsable, otorgada por el Estado con criterio de utilidad pública, que se destinará exclusivamente para formalizar en el Registro de Predios de la Superintendencia Nacional de Registros Públicos (SUNARP), la declaratoria de edificación existente y su independización como unidad inmobiliaria.

The Law establishes that immovable properties shall be entered in Land Registers and the rights related thereto shall be corroborated therein. Land Registers shall be available to everyone and the entries thereof shall be publicly reliable. Management of Land Registers shall be under the jurisdiction of the Land Register offices of regional courts. Each immovable property shall be entered in the Land Register in such Land Register office in the district of which it is located.

This Law prescribes the procedures by which the land regained or privatised by natural persons or legal persons, the land of the State and local governments, as well as apartments and buildings (structures), which are located on this land or in the land, shall be recorded in the land Registers. Rights related to immovable property shall be corroborated in the Land Register in accordance with the requirements specified in the Land Register Law, taking into account the provisions of this Law.
