The Act establishes that the right to administer soil, water and air is vested in the State. The State, therefore, has the authority to: (a) regulate the allotment, use, supply and maintenance of soil, water and air; (b) regulate the legal relations between persons and soil, water and air; (c) regulate the legal relations between persons and legal acts concerning soil, water and air. The exploitation of these resources both by individuals or corporate bodies is to be performed within the objective of the national interest and by guaranteeing the protection of economically-weak groups.

El presente Decreto introduce reformas a la Ley del Régimen especial de la tierra en propiedad de las asociaciones cooperativas, comunales y comunitarias campesinas, en relación a la transferencia de tierras y demás bienes agrarios a favor de los adjudicatarios del Instituto Salvadoreño de Transformación Agraria, que se realizará por escritura pública de compraventa, y si el precio se paga a plazos, la venta deberá efectuarse con garantía hipotecaria.

These Regulations provide the necessary procedures for the obtaining of conservation area consent for the demolition in a conservation area of a building which is neither a listed building nor an ecclesiastical building nor a building guarded, protected or scheduled under the Historic Monuments and Archaeological Objects (Northern Ireland) Order 1995. Applications for consent shall be made to the district council but a decision concerning consent shall be made by the district council or the Department of the Environment.

These Regulations transpose Directive 2006/21/EC of the European Parliament and of the Council on the management of waste from extractive industries and provides that planning permission for the management of extractive waste cannot be granted unless a waste management plan is approved by thedistrict council under these Regulations and provides that such permissions which involve waste facilities will be subject to conditions as set out in these Regulations.

These Regulations provide for the protection of trees. The Department of the Environment may make tree preservation orders. An Order shall be in the form set out in the Schedule and these Regulations prescribe the procedure for their making, modification, confirmation and revocation. As a rule, the consent of a district council is required before any tree protected by the order may be cut down, topped, lopped, uprooted, damaged or destroyed. The Regulations also make special provision in relation to trees in conservation areas.

These Regulations implement Directive 2011/92/EU of the European Parliament and of the Council on the assessment of the effects of certain public and private project They are concerned with the assessment of the effects of certain public and private developments on the environment and implement the EIA Directive in respect of the new two tier planning system under the Planning (Northern Ireland) Act 2011. The Regulations set out procedures and requirements for EIA to be submitted to a district council or the Department of the Environment.

This Order permits the management of development within a new two tier planning system with both district councils and the Department of the Environment operating as planning authorities where appropriate. An application for planning permission is to be made to the appropriate council or, as the case may be, the Department. The Order also deals with consultation before the grant of planning permission for development outlined in Schedule 3 and other procedures relative to planning permission application. Schedule 3 development also concerns water.

These Regulations specify the substances which are hazardous substances for the purposes of the Planning Act (Northern Ireland) 2011 and the controlled quantities of those substances. They also lay down the procedure for applications for consent and the determination of applications. Section 108 of the Act provides that the presence on, over or under land, of a hazardous substance equal to or in excess of the controlled quantity (as specified by Regulations) requires the consent of the district council.

These Rules make provision with respect to a public local inquiry to be held for the purpose of the section 231(1) of the Planning Act (Northern Ireland) 2011 regarding exercise of any of the functions of the Department of the Environment under that Act.

These Regulations amend the planning provisions in the Conservation (Natural Habitats, etc.) Regulations (NI) 1995 to ensure they will operate fully and effectively when district councils assume their new “competent authority” planning role under the Planning Act (Northern Ireland) 2011.

This Order, made bu the Department of the Environment in exercise of the powers conferred by section 32 of the Planning Act (Northern Ireland) 2011, grants planning permission in respect of certain development which is necessary for the purposes of housing poultry and other captive birds to protect them from avian influenza. The Order applies to land within a controlled zone, H5N1 controlled zone, wild bird control area or wild bird monitoring area declared by the Department of Agriculture and Rural Development and to any identified premises.

These Regulations prescribe the bodies the Department must consult for the purposes of section 104(5)(b) of the Planning Act (Northern Ireland) 2011 before making a conservation area designation. These bodies are, for the purposes of these Regulations, the Department of the Environment, the Department for Regional Development and any water or sewerage undertaker. They also prescribe bodies that must be consulted before varying or cancelling a conservation area designation (the council concerned, the Department for Regional Development and any water or sewerage undertaker).
