These Regulations provide for the creation and management of heritage parks, natural environment parks and recreation parks in compliance with the Territorial Parks Act. The Regulations are completed by three schedules, each dedicated to one category of parks.

They update the various statutory references to those currently in force and omit obsolete material relating to the repealed Community Land Act 1975.

Law No. 2.393, ruling on native populations’ permanence in Conservation Units.

This Law, composed of eight articles, rules on native populations’ permanence in Conservation Units. The Law authorises the State Government to grant the right of using the occupied land to those native populations residing since over 50 years in Rio De Janeiro Conservation Units. The Law also requires native populations to actively participate in the preservation of the aforesaid units. To this end, the Law specifies forbidden activities, natural resources’ conservation duties as well as fines and penalties for non compliance.

The authorities set out in the First Schedule are hereby appointed as the planning authorities for the respective areas described in that Schedule. The functions of the Minister under subsections (1) and (2) of section twenty-five of the Act relating to the grant or refusal of permission to develop or subdivide land are hereby delegated to the planning authorities set out in the Schedule for the respective areas described in that Schedule.

These Regulations shall apply to all claims for compensation made under the provisions of Part VI of the Town and Country Act. They provide for the making of a claim, establish the period within which claim may be made, prescribe supporting evidence and define where a planning authority is not liable for compensation. If the claimant does not accept the amount of compensation as determined by the Minister or planning authority, the amount of compensation shall be determined by the High Court. These Regulations shall apply to any enforcement notice served under the provisions of section thirty-one of the Town and Country Planning Act. An enforcement notice shall be in the form set out in Part I or Part II of the Schedule. The Minister or planning authority, as the case may be, shall keep a register containing the information in respect of every enforcement notice he or it serves as specified in regulation 5. The register shall be kept at the office of the Minister or planning authority, as the case may be, and made available for inspection by the public.
