This Act regulates the management of commissioners’ land, i.e. the lands acquired by the Territories with Territorial funds before, on or after June 27, 1969; public lands the administration of which has before, on or after June 27, 1969, been transferred by the Governor in Council to the Territories; all roads, streets, lanes and trails on public lands, and lands acquired by the Territories pursuant to tax sale proceedings (sect. 2) The Act but does not apply in respect of any mines or minerals under or within such lands.

This Decree-Law, composed of 25 articles, revises the legal regime of Regional Territorial Plans (PROT) with the aim of a correct territorial order matching at the same time local and national interests. In particular, it defines the competences of the Ministry for Planning and Territorial Management, the deadlines for their preparation and their technical requirements.

This Act provides for the procedures related to expropriation and the management of abandoned land. It addresses matters related to compensation and regulates the use of expropriated lands.

Ce décret modifie certaines dispositions du Code de l'urbanisme relatives aux documents d'urbanisme, et notamment au schéma de cohérence territoriale, qui comprend un rapport de présentation, un projet d'aménagement et de développement durable et un document d'orientations générales assortis de documents graphiques.

These Regulations further implement, in relation to water management projects for agriculture including irrigation and land drainage projects in Scotland, Council Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment, as amended by Council Directive 97/11/EC. Regulation 2 amends the definition of development in the Town and Country Planning (Scotland) Act 1997 to include the carrying out of irrigation or drainage for agriculture or of any other water management project for that purpose.

These Regulations amend the principal Regulations, which provide for payments of aid to be made to any person who enters into an undertaking with the Scottish Ministers to comply with the general environmental requirements set out in Schedule 1 and to carry out, or as the case may be, to carry out and maintain, at least one of either the management activities set out in Schedule 2 or the capital activities set out in Schedule 3 to the principal Regulations. Schedule 4 to the principal Regulations makes provision for rates of payment for management and capital activities.

This Order consolidates with amendments the permitted development provisions of the Town and Country Planning (General Amendment) (Scotland) Order 1981 and subsequent amending instruments. The main purpose of this Order is to permit certain classes of development without express planning permission being granted under the Town and Country Planning (Scotland) Act 1972. Schedule 1 to the Order sets out these classes of development in detail, subject to articles 3 to 7.

The present Regional Act lays down the legislative framework in matter of town and country planning. The regional territory shall be managed through plans adopted and implemented at the municipal, provincial and regional levels, pursuant to the principles of coordination and subsidiarity (art. 3). Title II (arts. 12-30) defines with detail the above-mentioned plans. Title V (arts. 43-45) is entirely devoted to the protection of agricultural lands and building in such lands.

The 278 sections are divided into 14 Parts: Administration (I); Development Plans (II); Control Over Development (III); Compensation For Effects Of Certain Orders, Notices Etc. (IV); Rights Of Owners Etc. To Require Purchase Of Interests (V); Enforcement (VI); Special Controls (VII); Acquisition And Appropriation Of Land For Planning Purposes Etc. (VIII); Roads, Footpaths And Rights Of Way (IX); Statutory Undertakers (X); Validity (XI); Crown Land (XII); Financial Provisions (XIII); Miscellaneous And General Provisions (XIV).

These Regulations provide for the creation and management of heritage parks, natural environment parks and recreation parks in compliance with the Territorial Parks Act. The Regulations are completed by three schedules, each dedicated to one category of parks.
