Comenzando con una breve revisión histórica, este artículo pretende exponer las razones principales que determinan la improcedencia de la Ley Orgánica de Tierras Rurales y Territorios Ancestrales, la que se publicó en el Suplemento del Registro Oficial N.-711, de 14 de marzo de 2016.

El artículo hace una presentación y análisis del poder de policía de la Administración, así como de la doctrina de la intervención en el orden público económico, los cuales fundamentan el desarrollo de nueva regulación que, debido a sus efectos, puede tenerse como expropiatoria de inversión extranjera amparada por acuerdos de promoción de inversiones (Bilateral Investment Treaties, BITs) y Tratados de Libre Comercio (TLCs).

El trabajo consiste en un estudio histórico y crítico de los mecanismos jurídicos de protección de las tierras de la población desplazada, en el cual se revisan las políticas públicas y la legislación que ha tenido incidencia en la materia.

La presente investigación titulada: “La restitución de tierras en Colombia: un instrumento para reparar las víctimas del conflicto armado o un instrumento político para el desarrollo económico”, se enmarca dentro de los estudios de instrumentos de la política pública y la plantea como interrogante central: ¿Por qué se privilegió la restitución de tierras, Ley 1448 del 2011, como el instrumento para reparar los derechos fundamentales de las víctimas del desplazamiento forzado en Colombia?

Forests at the tropical Valley of the Apurimac and Ene rivers (VRAE), the second coca-growing region of Peru, are public common resources and nevertheless privately managed mainly by coca farmers, without effective State control of such use. The need for survival of the coca farmers, their chrematistic perception of the forest, the cultivation of cocoa (theobroma cacao) and land availability are crucial factors influencing the rates of deforestation of primary and secondary forest. Variables such as the legality of land tenure seem to have no influence.

Este artículo trata de las respuestas mediáticas a la crisis actual en la Costa Caribe de Nicaragua y los retrocesos a las luchas regionales por la autonomía y los derechos a la tierra. Proporciona un panorama detallado del actual conflicto en el Caribe Norte, en particular cómo las acciones violentas de los colonos ilegales están acelerando la inseguridad y la degradación ambiental y cómo organizaciones de derechos humanos como CEJUDCHAN están utilizando espacios como YouTube para responder a esta situación.

The concept of “property”, usually studied under private law, has suffered internal (the social function as an essential element of the institution) and external (the administrative limitations) changes. As a result of these changes, the concept of property should be studied under the public law´s approach and method. An issue of utmost importance to public law is that it be properly and adequately articulated by the administrative authorities in order to protect the citizens’ rights.

El presente trabajo se propuso determinar, si el procedimiento de prescripción adquisitiva administrativa sobre predios rústicos establecido en el Decreto Supremo 032-2008-VIVIENDA (Reglamento del Decreto Legislativo 1089), viola o no el derecho de defensa de los propietarios involucrados. Todo ello, ante la reforma introducida a la legislación de prescripción adquisitiva sobre predios rústicos regulado por el Decreto Legislativo 667.

Improving land governance is key in assuring that land resources can be enjoyed by all parts of the population. Donors can play an important role in combatting corruption in land administration and building a well-functioning land administration by both supporting domestic government efforts as well as engaging in international and multi-country initiatives. However, donors are advised by experts and civil society organisations to be mindful of the possible impact of their interventions on issues of land grabbing and forced relocations.

This paper draws out the key links between land tenure and poverty eradication. The author argues that in countries where land distribution remains highly inequitable, effectively designed and targeted, it could be a key component of anti-poverty strategies, but significant complementary measures, notably agrarian support services, are also required to achieve real impacts, together with investments in employment and economic diversification.

This paper investigates how HIV/AIDS affects land access, utilisation and control in Malawi, with a particular focus upon vulnerable groups. It presents findings on the effect of HIV/AIDS on land holding, household responses to HIV/AIDS (to ensure their ability to continue using land as a resource), implications for tenure, effect of HIV/AIDS on land administration institutions, and the role of national legal and policy frameworks.The paper recommends:Firstly, that there is a need to raise the profile of the challenge posed by HIV/AIDS to poverty reduction.
