This Chapter concerns the recording of conveyance of real property and the effects of recording. The term conveyance embraces every instrument in writing by which any estate or interest in real property is created, alienated, mortgaged, or encumbered, or by which the title to any real property may be affected, except wills. Every conveyance of real property acknowledged or proved and certified and recorded as prescribed by law from the time it is filed with the Director of Land Management is constructive notice of the contents thereof to subsequent purchasers and mortgagees.

This Chapter provides for a series of general matters with respect to real or immovable property such as classification of estates, the definition of ownership issues, limitations on full ownership, reversions, remainder of former estate, suspension of ownership, limitations on Life Estates, rights of heirs of life tenants, etc. Estates in real property, in respect to the duration of their enjoyment, are either: estates of inheritance or perpetual estates; estates for life; estates for years; or estates at will.

This Chapter defines the duties of tenant for life, coterminous owners, two or more persons are associated by agreement in the use of an asset belonging to a property, etc. The owner of a life Estate shall be required to carry out duties defines in section 1 with respect to the estate. Neighbouring owners are mutually bound equally to maintain the boundaries, monuments and fences between them.

Article 5 of the Law No. 214-1 on peasant farm acquires a new wording: «The plot of land of a peasant farm shall be inherited according to the modalities envisaged by the national legislation». Article 6 of the same Act acquires a new wording: «The plots of land for farming shall be allotted to the citizens of the Republic of Kazakhstan on condition of ownership or on condition of temporary charged lease for the period up to 49 years and for seasonal grazing on condition of temporary land tenure free of charge».

Section 4 regards specific nature of mortgage (hypothecation) of land sites. It specifies that According to agreement on hypothecation, land sites in ownership may be given to mortgage. Hypothecation of land sites in collective ownership in residential areas, including those in towns, where in accordance with regulations on urban development it is prohibited to erect buildings and structures at specially protected territories and in zones, land sites intended for special use, belonging to state or municipal bodies, is not permitted.

This Chapter defines certain rights and owners of real property and tenants for life. The owner of a life estate may use the land in the same manner as the owner of a fee simple, except that he or she must do no act to the injury of the inheritance. Sections 2 and 3 of Article 1 define property rights of a Tenants for Years. Section 6 defines rights of lessees and assignees against his immediate lessor, for the breach of any agreement in the lease.

This Chapter defines property and ownership in general and contains various rules regarding the property of land, fixtures and wild animals. This Act defines “ownership”, “property”, “real property” “land” and “appurtenances” and contains rules relative to ownership of real property. The Act also contains a clause on the ownership of wild animals. The Act declares that animals wild by nature are the subject of ownership, while living, only when on the land of the person claiming them, or when tamed, or taken and held in possession, or disabled and immediately pursued.

The purpose of this Chapter is to establish a uniform policy for the fair and equitable treatment of persons displaced by the acquisition of real property under Government of Guam land acquisition programs, by building code enforcement activities, or by a program of voluntary rehabilitation of buildings or other improvements conducted pursuant to governmental supervision (sect. 1). Marketable Title Act - Chapter 39 of 21 GCA “Real Property”.

Any person having the legal capacity to own land in the Territory of Guam, who has an unbroken chain of title to any interest in land by himself and his immediate and remote grantors since January 1, 1935, and is in possession of such land, shall be deemed to have a marketable record title to such interests, subject only to such claims thereto and defects of title as are not extinguished or barred by the application of the provisions of this Chapter and instruments which have been recorded since January 1, 1935.

This Chapter regulates certain aspects (requisites, effect of transfer, form of grant, etc.) of the transfer of real property. An estate in real property, other than an estate at will or for a term not exceeding one year, can be transferred only by operation of law, or by an instrument in writing, subscribed by the party disposing of the same, or by his agent thereunto authorized by writing (sect. 1 of Article 1). Section 2 of Artcile 1 defines the form of grant of an estate in real property.
