These Rules amend the Land Registration (Network Access) Rules 2008 in consequence of changes under the Legal Services Act 2007 to the regulation of persons carrying out legal activities, and the introduction of alternative business structures. The amendments concern, among other things: interventions by new regulators or licensing authorities coming into being under that Act; and access rules for authorized persons.

This Ministerial Decision implements the Decree that regulates the right of use and conditions for exploiting public land by establishing the procedures for consultation with the local communities on the use and property rights of land. The local community's consultation includes two phases. The first is a public meeting in order to provide information to the local community on the application for acquisition of land use rights and the identification of the boundaries of the parcel. The second relates to the duration of the consultation.

The present Regulation lays down provisions relating to electronic registration under the Land Registration Reform Act. Section 2 establishes that no person shall submit a document for electronic registration until having obtained a registration account number or other authorization from the land registrar of the land registry office where the person submits the document or a person authorized by the Director. The present Regulation implements the Federal Act on land law and land rights of 21 December 2004. In particular, it lays down provisions relating to land rights in the Canton of Obwalden. Furthermore, it establishes a Land Right Commission (Bodenrechtskommission).The said Commission shall, inter alias, survey subdivisions of agricultural land and registrations in the cadastre. These Rules implement selected provisions of the Registered Land Act. They define the form of the register in the First Schedule and the form of a title deed and a certificate of lease in the Second Schedule. Any register, certificate of freehold title or instrument which complies with the form prescribed under the Land Consolidation Act shall be deemed to comply with these Rules. The Rules contain other provisions regarding forms, provide for the verification of instruments, prescribe fees for registration and limit powers of the Registrar to prepare a title or registration instrument.

This Regulation provides various rules and provisions all aimed to define the concrete establishment and maintenance of the real estate cadastre (on the territory of the Republic of Srpska, autonomous district of the Federation of Bosnia and Herzegovina).The provided provisions are also established in order to define the procedure of public display of data on immovable property, including the related property rights.The Annex is an integral part of this Regulation.

These Rules prescribe in the Schedule forms that shall be used in all cases under Part X of the Government Lands Act.

These Rules establish Government Lands Registration Offices at Nairobi and Mombasa and specify for each office the transactions relating to Government land that shall be registered in that office.

These Rules concern the registration of any assignment of a lease issued under the Government Lands Act where the premium reserved by such lease is payable to the Government by instalments. The Registrar shall not register such lease unless and until the head lease thereof is produced duly endorsed by the Commissioner of Lands, as provided for in subsection (4) of section 24 of the Act. The endorsement shall also be registered under the Act.
