This Act provides rules relative to the exploration for and the exploitation of oil resources in Uganda. The Act also imposes certain duties on licence holders with respect to the protection of the environment and in case of emergencies. No person shall carry on any exploration or development operations on petroleum in or upon any land in Uganda except under, and in accordance with, a licence issued under this Act. The Government may enter into an agreement for the grant of a licence.

The Law determines the basic principles of the organization and regulation of activities in the fuel and energy sector. All primary energy resources shall be the exclusive property of the state and the management thereof shall be subject to licensing. The Law shall be applicable to energy production, transmission, storage and to such fuels as oil, natural gas, coal and renewable sources of energy.

Section 3 prescribes that no person shall explore, prospect or mine for petroleum except by virtue of an exploration licence or a petroleum agreement issued or entered into the provisions of this Act. Any person desirous of exploring, prospecting or mining for petroleum may apply to His Majesty in Council for an exploration licence or a petroleum agreement in respect of any area of land. Section 5 sets out the manner in which application may be made. His Majesty in Council may issue in respect of the same area of land more than one exploration licence.

The Law provides for mining and exploitation of mineral resources as natural gas, petroleum, crude oil and assorted minerals. Prospectors must apply for a prospecting licence that shall be granted after the payment of a fee. Lands alienated for the purpose of mining operations shall be paid off as rent and royalties. Lands comprise also the continental shelf. Mining leases shall comply with land laws as per the survey, delimitations, land tenure and revenues and acquisition.

This Law regulates the exploration for and development and production of petroleum in Ghana and defines duties and rights of persons involved in such exploration, development or production. No person, except the Ghana National Petroleum Corporation shall engage in the exploration or production of petroleum except in accordance with the terms of a petroleum agreement or any other authority granted or recognized under this Law.

This Act makes provision for various matters relating to the activity of exploration and exploitation of petroleum resources in Botswana including licensing, control, surface rights, survey of wells, protection of the environment and compulsory acquisition of land.The Act sets out criteria and conditions for the granting of an exploration or a development licence. The Minister may enter into an agreement with a (potential) licence holder. A registered holder of an exploration licence shall notify the Minister on the discovery of petroleum in an exploration area.

The present Regulations enact section 10 of the Mineral Resources Act, 1959, which was repealed by the Crown Minerals Act (C-50.2), but these Regulations continue in force under the Crown Minerals Act. In particular, the Act lays down provisions relating to permits and licences of shale exploration. El presente Decreto tiene por objeto establecer las atribuciones, los procedimientos y los mecanismos del monitoreo socio-ambiental relativos a todas las actividades hidrocarburíferas que tengan influencia en los territorios de los pueblos indígenas originarios y comunidades campesinas. Asimismo, el Decreto define el marco institucional para las actividades de monitoreo socio-ambiental, cuya autoridad principal estará constituida por el Comité de Monitoreo Socio-Ambiental Nacional.

El presente Decreto regula el proceso de consulta y participación de los pueblos indígenas, originarios y comunidades campesinas en los casos en que se pretenda llevar a cabo actividades hidrocarburíferas en sus tierras comunitarias de origen y tierras de ocupación y acceso. Los principios sobre los que se basa el mencionado proceso de consulta son el de garantía de la integridad de las tierras de propiedad de los pueblos indígenas y comunidades campesinas, información previa y oportuna con respecto a las actividades hidrocarburíferas, participación y transparencia.
