The present Regulation provides for the enactment of the Public Land Act. The Regulation focuses on three key themes: land management, compliance and enforcement, appeals and dispute resolution. The Regulation applies to provincial land managed by Sustainable Resource Development under the Public Lands Act. The new rules around recreation apply to vacant public land not held under a disposition that offers exclusive use. The Regulation does not apply to parks/wilderness areas (managed by Tourism, Parks and Recreation) or lands managed by Transportation or Infrastructure.

The purpose of this Act is, inter alia, to provide a means by which the Government can give direction and provide leadership in identifying the objectives of the Province of Alberta, including economic, environmental and social objectives. The text consists of 96 sections divided into 5 Parts as follows: Regional plans (1); Nature and effect of regional plans and compliance declarations (2); Conservation and stewardship tools (3); Regional planning process and its administration (4); Transitional provisions, related amendments and coming into force (5).

The present Act provides protection for both parties under a lease or agreement for sale for land where payment is made with the crops grown on said land. In particular, the Act operates when, pursuant to a lease, sale, or first mortgage on a piece of land, there is provision made to pay the rent, purchase money, or mortgage money either in whole or part with crops grown on that land. The maximum amount of any lien or charge which may be charged as a result of the transaction is one third of the value of the crop.

The present Regulation is made under the Expropriation Act. The Regulation lays down provisions relation to compensation procedures. In particular, the text – consisting of 20 sections – deals, amongst others, with the following aspects: application for determination of compensation, reply to application, notice to commence proceedings, provision of information, commencement of other proceedings, forms, proceedings before Board and repeal. One Schedule consisting of 4 forms is enclosed.
