In Cambodia, an increasing demand for land has accompanied rapid economic expansion over the past decade, leading to land tenure insecurity for many of the country's poor. Despite the adoption of a new land law in 2001 and the establishment of the Land Management and Administration Project (LMAP) in 2002, tenure problems have continued. The difficulties with land reform policy relate partly to LMAP's design problems and partly to poor execution.

ABSTRACTED FROM THE INTRODUCTION: The present study is a result of a three-month research stay and internship with the Lutheran World Federation Cambodia (LWF), in Kampong Chhnang Province. It deals with a land dispute that was closely monitored by LWF and that serves as an example for ways in which land disputes are dealt with in the rural Cambodia of today.

Since the 1980s, while trying to maintain political stability and territorial integrity, the Vietnamese state has strongly moved towards the transformation of a centrally-planned economy to a more market-oriented model, in which private, foreign and joint-venture businesses are increasingly becoming the key pillars of the national economy.

ABSTRACTED FROM SUMMARY: A bitter land struggle is unfolding in northern Burma’s remote Hugawng Valley. Farmers that have been living for generations in the valley are defying one of the country’s most powerful tycoons as his company establishes massive mono-crop plantations in what happens to be the world’s largest tiger reserve. The Hukawng Valley Tiger Reserve in Kachin State was declared by the Myanmar Government in 2001 with the support of the US-based Wildlife Conservation Society.

This study attempts to understand the impact of economic land concessions for agro-industrial production promoted by the government. This promotion heavily impacts on the locals’ livelihoods and obstructs decentralized natural resource management, especially in natural forest resources. They also examined locals’ response to such a development scheme. The study found that in regard to “economic growth”, the state has very strong control over natural resources and people.

ABSTRACTED FROM THE INTRODUCTION: There is little evidence... that ordinary Cambodians are benefiting from the mass confiscation of their land. On the contrary, those who are displaced are explicitly excluded from any benefits, and instead find themselves facing loss of income, poor health, lack of education and other dire consequences that are directly opposed to the government’s public commitment to development, expressed through targets such as the “Millennium Development Goals” (MDG).

This paper examines the institutional changes in Vietnam's urban development that have emerged as the economy has been restructured in a deliberate national policy entitled Doi Moi. The main focus is on the issue of compensation in land acquisition. Data were collected from field reconnaissance surveys, key informant interviews and secondary sources. Findings revealed a clear move towards the establishment of private property rights on land use, illustrated by the changes associated with land law and the dynamic interplays among the main actors in this transition.

OVERVIEW: Cambodia is a largely agrarian country that emerged from a history of political strife and instability into a period of steady economic growth. However, the country started from such a low base that even after a decade of growth averaging 7% per annum, GDP is only $650. Cambodia is ranked 176th out of 213 countries in terms of purchasing-power parity. Poverty rates have reduced somewhat, but they remain higher than in most countries in the region and are only slightly lower than in Laos.

The rise of urbanization and development in Cambodia in recent years has led to a dramatic increase in land prices, with particularly high values for land in the capital city of Phnom Penh. Some government officials have benefited from the high price of land by unlawfully granting land title to private developers in exchange for compensation. Once these officials have granted land title to developers, they forcibly evict from the property existing residents, who mostly come from poor and marginalized communities. There is rampant corruption at every stage of the "development" process.

The Land Law of 2001 was a landmark statute intended to strengthen and protect the rights of ordinary Cambodian landholders. A land titling programme (LMAP) was initiated soon afterwards, with extensive World Bank and donor support. The land occupied by the community of Boeung Kak, in the heart of the capital was excluded from this process, despite evidence of prior residence going back decades. Instead it was classifi ed as having “unknown status” by the LMAP, as “state land” by default, and as a “development zone” by authorities.

INTRODUCTION: What is property? What do rights to property cover and what are their limits? To whom do these rights belong? In an era where everything can become a commodity, be branded, trademarked and copyrighted, disputes over property and property rights uncover tensions at every level of society, between and among different levels of the state and various social configurations, from individuals to neighborhoods and whole villages. Disputes over property are also disputes between competing social goods and values.
