The typology of property formation in course of land reform in Estonia

The implementation of land reform has influenced the formation of property structure. The main procedures of land reform activities are stated in Estonian legislation. However, the provisions for determining the area and the boundaries for properties to be formed in the course of land reform are stated in legal acts in an unsystematic way. The aim of this study is to systematize the parcel area and the boundaries determination procedures that are used in the course of land reform for property formation.

In the conditions of the Republic of Belarus there was analysed the experience of state regulation of agricultural lands rotation in foreign countries. There were determined the key aspects of functioning of developed market of agricultural lands, which should be accounted and controlled by organs of state authority. Since 2004, we have witnessed an increased demand in the acquisition of agricultural property, both by individual farmers and entities not previously associated with agriculture. A significant increase in the transaction prices of agricultural real estate in recent years has been caused by the impact of limited agricultural land supply and external factors related to the functioning of Polish agriculture in the economy of the European Community. The Landsat TM/ETM images obtained in 2000, 2006 and 2010 were used to generate Land Use and Land Cover (LULC)maps of Canakkale province including forest,grassland,agriculture,water and residential area bare soil classes.

The expropriation value of agricultural land is determined by the income capitalization approach under Turkey's Expropriation Act. Accordingly, the value of land is determined by dividing net income by the capitalization rate. One of the major issues giving rise to misunderstanding in expropriation cases is the misuse of the capitalization rate. Currently, the overextending of expropriation cases contributes to investment latency and the escalation of expropriation costs.

Ownership of agricultural land is very fragmented in Turkey, as is the case in countries within central Europe. This prevents agricultural efficiency from reaching desired levels. Land consolidation involves redistributing land ownership so that individual farmers own fewer, larger, more compact and more contiguous land parcels. In Turkey, generally voluntary land consolidation projects are performed, while some financial limitations and political conditions prevent land consolidation reach to its desired level.

Assessing the value of the state support for the agriculture is important for solving the problems of regional and federal agrarian policy. In the result of calculations carried out under the state support assessment procedure of the Organization of Economic Cooperation and Development (OECD) based on comparing domestic and world (reference) process for products and resources inadequate conclusions on the support of agriculture in Russia and its agrarian policy are made.

Regulations require that real property cadastral assessment should be used internationally recognized real property evaluation methods - the method of comparison, cost method and income capitalization method. The study assessed content and nature of evaluation methods. The studied, which the evaluation methods today are likely to use in the cadastral assessment and which depends on the database of stored information. The main conclusion of the study is that the cadastral assessment using as many methods possible to obtain a more objective cadastral value.

Proposal for New Land Valuation Practices in Landscape Consolidations

Land valuation in the landscape consolidation projects is currently based on the Decree no. 38/2005 Coll on determining the value of land and plantations for the purpose of land consolidations. Land value is determined using the evaluation map which in turn is created from the updated ESQU (BPEJ) in the area of the landscape consolidation project. The intersection of the layer of plots' boundaries with the evaluation map is the basis for determining the value of existing and new plots.
