The purpose of the present Act is to: a) provide certainty in ownership of interests in land; b) simplify proof of ownership of interests in land; c) facilitate the economic and efficient execution of transactions affecting interests in land; and d) provide compensation for persons who sustain loss from a failure of the land registration system.

La présente loi s’applique à toute expropriation à réaliser sur le territoire du canton, à moins que la législation fédérale ne soit exclusivement applicable. La présente loi s’applique également à l’indemnisation due en cas de restriction de la propriété équivalant à une expropriation (expropriation matérielle). L’expropriation n’est admissible que dans les cas d’utilité publique déterminés par une loi et dans la mesure où la réalisation de l’ouvrage correspond à un intérêt public. Le chapitre III du livre I définit la composition et le fonctionnement de la Commission d’expropriation.

This Act defines the liability of an occupier of premises for injury to persons or damage caused to goods and resulting from actions or omissions of the occupier in respect of the occupied property. The Act also defines the liability of a landlord under the obligation of maintenance or repair of the occupied property. Where an occupier of premises is bound by contract to permit third persons to enter or use the premises, the duty of care which is owed to them by the occupier cannot be restricted or excluded by that contract.

This Legislative Decree approves the Code on the Environment, which sets out the legislative framework applicable to all matters concerning environmental protection.The Code is composed of six Parts. Part I (arts. 1-3) defines the application scope and lays down general provisions applicable to all areas covered by the Code. La présente loi porte réglementation relative à l’expropriation pour cause d’utilité publique. L’article 1er établit que l'expropriation formelle est un acte administratif par lequel une personne est contrainte, pour cause d'utilité publique et moyennant une pleine indemnité, de céder, en tout ou en partie, son droit de propriété ou tout autre droit réel ou personnel sur un immeuble, ou de supporter une restriction dans l'exercice de ces droits.

L’article 1er de la loi susvisée établit que l’expropriation est la procédure par laquelle une personne est contrainte de céder sa propriété ou tout autre droit sur un immeuble ou sur un meuble totalement ou partiellement. L'expropriation peut avoir pour objet la propriété d'un immeuble ou d'un meuble, une propriété immatérielle, tout autre droit réel portant sur un immeuble ou un meuble, les droits de voisinage, ainsi que les droits personnels des locataires ou fermiers de l'immeuble à exproprier.

The present Act lays down provisions relating to the expropriation of land. Article 1 establishes that the right to property is guaranteed. Nevertheless, the Canton may acquire land or objects - if it is in the interest of the public - by means of expropriation. Article 2 lists the cases in which the competent authority may initiate expropriation proceedings.

The object of this Law is: (a) the just regulation of the issues of property rights that have arisen from expropriation, nationalization, or confiscation; (b) restitution and compensation, whenever restitution is not possible; (c) the procedures for accomplishing restitution and compensation of property and the administrative bodies charged with its completion.

These Guidelines establish the modalities of the calculation of damage caused to atmosphere, land and water resources by chemicals, regulate calculation of payment for the compensation of damage caused to land by oil pollution and shall be applicable to all land categories. The Guidelines shall be applicable to dispute settlement regarding environmental offences and shall be used by the authorized environmental institutions and nature managers carrying out oil transactions. Damages shall be intended losses related to the mitigation of the consequences of environmental pollution.

The present Law lays down provisions relating to expropriation proceedings in the Canton within of Schaffhausen. The text consists of 38 articles divided into 9 Parts as follows: Expropriation Law (I); Right of restitution (II); Compensation (III); Expropriation proceedings (VI); Cantonal Commission for assessment of compensation (V); Assessment proceedingss (VI); Appeal proceedings (VII); Implementation of expropriation (VIII); Proceedings relating to certain expropriations (VIIIa); Final provisions (IX).

This Ministerial Decree regulates submittal and examination of the applications for the expropriation of land for public needs, assessment of compensation of damage caused thereby to landowners and other land managers. Expropriation of land for public needs shall be carried out by: (a) decision of the head of local administration for areas of up to one hectare in the cities and for up to ten hectares in the countryside; and (b) governmental decision for the areas exceeding the aforesaid limits.
