Le présent décret fixe l’organisation du Ministère des Domaines et des Affaires Foncières, responsable de l’élaboration et de la mise en œuvre de la politique du Gouvernement en matière domaniale, cadastrale et foncière.Le Ministre des Domaines et des Affaires Foncières est chargé de l’élaboration, de la mise en œuvre, de l’évaluation de la politique du Gouvernement en matière domaniale, foncière et cadastrale.

Le présent arrêté du Gouvernement wallon met en exécution le décret du 20 octobre 2016 limitant les fermages. Notamment, l’arrêté du Gouvernement wallon définit les régions agricoles présentes sur le territoire de la Région wallonne. L’article 1er établit qu’en application de l'article 2, § 1er, alinéa 2, du décret susvisé, les régions agricoles sont les régions aux caractéristiques naturelles et au potentiel agro-économique spécifique définies par l'arrêté royal du 24 février 1951 fixant la délimitation des régions agricoles du Royaume.

Le présent décret limite les fermages. Notamment, l’article 1er établit que le fermage maximal d'une terre donnée en location est son revenu cadastral non indexé multiplié par un coefficient. This Law defines the legal, organizational, economic and social principles of conducting smallholding activity. Smallholding (individual peasant farm) shall be a business activity that is carried out without the creation of a legal entity by an individual or by family members or relatives that live together in order to meet their personal needs through the production, processing and consumption of agricultural products, vending of its surpluses and the provision of services using the property of a private peasant farm, also in the field of rural green tourism.

This Act makes provisions for the alienation of private (custom) land and the use of public land by custom users, the development of public land and various other matters relative to land titles, use and management.The Act consists of 24 sections divided into 13 Parts: Interpretation (1); Encumbrances (2); Alienated Land (3); Negotiations and Agreements Relating to Custom Land (4); Management of Land (5); Public Land (6); Compensation (6a); Registered Leases (7); Rights of Entry (8); Land Corporations (9); Roads (10); Use of Force and Damage (11); Regulations and Offences (12).The Minister

This Act makes provision with respect to the creation and registration of leases. There shall be a Land Leases Register for the registration of each lease required to be registered by this Act. The Act defines various conditions applying to a registered lease and the effects of registration. Other provisions of this Act concern other titles in land such as mortgages and easements, co-ownership, transmission, trusts, and cautions.

Le présent décret, pris en application des dispositions la loi n° 14/63 du 8 mai 1963 fixant la composition du domaine de l’Etat et les règles qui en déterminent les modes de gestion et d’aliénation, détermine les règles applicables aux cessions et locations des terres domaniales, c'est-à-dire les terres faisant partie du domaine privé de l'Etat et qui ne sont pas affectées à un service public ou une personne privée investie d'une mission de service public.

Le présent décret fixe l'organisation des conservations de la propriété foncière et des hypothèques. Les services techniques comprennent : le service d'immatriculation ; le service de la publicité foncière ; le service de l’informatique, des archives et de la recherche, le service de la législation et du contentieux, et le service administratif, financier et comptable.Cette Ordonnance qui s’applique aux immeubles bâtis et non bâtis soumis au régime de l’immatriculation foncière, fixe le régime de la propriété foncière en en République gabonaise.

These Rules amend the Registered Land Rules in the Third Schedule. The Third Schedule prescribes forms for purposes of the Registered Land Act. Form R.L. 2 is amended by deleting the attestation clause and substituting therefore a new clause. This form concerns the transfer of a lease.

Article 1 shall be amended to add the following wording: “Leaseholder of a plot of agricultural land pertaining to public or municipal ownership shall have the right of purchase of such plot of land in ownership in case the right of lease originates from conversion of permanent (open-ended) tenancy or life-long hereditary possession of such plot of land to lease, at the cost equal to 15 percent of its cadastre value”.
