Au cours des trente dernières années, un nombre croissant d'États ont adopté de bonnes lois qui renforcent considérablement les droits fonciers de leurs citoyens. Cependant, en raison de multiples obstacles, un pourcentage élevé de citoyens de nombreux pays ignorent leurs droits légaux ou sont incapables d'utiliser les lois nationales pour protéger leurs droits lorsque ces derniers sont menacés.

Cette étude est le troisième volet d’une série consacrée à l’accès à la terre, thématique centrale du programme 2017-2021 d’Entraide et Fraternité. Les deux premiers volets ont été consacrés en 2018, à Madagascar et en 2019, aux Philippines.

Land and labour rights can intersect in multiple ways. Investments in large-scale plantations often entail trade-offs between job creation and compressions of land rights. Also, labour relations can involve tenure dimensions, for example where estate managers sublet plots for workers to complement wages with food production for their family or local markets.

After the political change in Nepal of 1951, leapfrog land policy improvements have been recorded, however, the land reform initiatives have been short of full success. Despite a land administration system based on cadaster and land registries in place, 25% of the arable land with an estimated 10 million spatial units on the ground are informally occupied and are off-register. Recently, a strong political will has emerged to ensure land rights for all.

This guide is intended to supplement other resources that provide broader overviews of human rights due diligence. It will be particularly helpful for downstream businesses or investors as they navigate how to identify, address, and track the impacts of their value chains on indigenous peoples. The guide will also be useful for policymakers as they design due diligence legislation.

The recognition of customary tenure systems and responsible land-based investments that safeguard legitimate tenure rights and right holders are the interconnected main themes for mainstreaming the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security (VGGT) in Cambodia, Lao People’s Democratic Republic, Myanmar and Viet Nam.

It is widely understood that effective use of land, the sustainable production of food and development are linked. Yet, creating effective policy, which takes into account broader notions such as economic prosperity and social justice, especially in the context of competing claims to land use and title, still presents significant challenges. The difficulties are compounded by the fragmented nature of information resources about land.
