Article 15 shall be amended to add the following wording: “Proclamation of natural complexes and nature monuments of regional significance shall be performed by decision of the Regional Government”.

Article 4 shall be amended to add the following wording: “Plenary powers of the Regional Government in the sphere of conservation, management and promotion of the objects of cultural heritage shall include participation in common state policy, elaboration and validation of regional state programs, organization of regional protected areas and establishment of the boundaries thereof”.

Article 4 shall be amended to add the following wording: “Local self-government bodies shall perform the following plenary powers in the sphere of management and conservation of the objects of cultural heritage: (a) conservation, management and promotion of the objects of cultural heritage pertaining to municipal units; (b) state protection of the objects of cultural heritage; (c) organization of local protected areas containing objects of cultural heritage; and (d) access of handicapped persons to the objects of cultural heritage”.

The aim of this Act is to re-establish protected areas on land previously owned by agricultural cooperatives before privatization. This goal is achieved through: expropriation, if the area has already been assigned to a private owner; or by not assigning such lands to private owners. Paragraphs 2-4 deal with cases in which expropriation is not obligatory and with cases in which compensation should be paid to the owner. Expropriation should be carried out, at the latest, within 3 years from the entry into force of this Act.

The scope of this Regional Law shall be to perform legal regulation of the issues related to ownership, tenancy and governance of land, including agricultural land, land shares in common ownership, and also relations concerning land reservation and land expropriation.

Article 14 shall be amended to add the following wording: “Boundaries of protected areas and protection areas of some categories of regional significance shall be delimited on site with special signs and shall be mapped on land-use planning documentation”.

Article 1 shall be amended to add the following wording: “Dendrological park shall be considered protected area constituted for the formation of special collection of wild flora species with a view of conservation of vegetable kingdom and its diversity. Natural park shall be considered protected area of regional significance within which boundaries shall be separated areas of ecological, cultural and recreational importance and in relation thereto shall be imposed restrictions on economic and other activities”.

This Regional Law regulates relations in the sphere of organization, protection and management of protected areas of regional and local significance.

Article 8 shall be amended to add the following wording: “Guardianship of protected areas of regional significance shall be performed by state bodies that administer them”.

The purpose of the present Law is to use the soil in a rational and efficient way, to conserve natural living conditions, as well as the beauty of the landscape. It regulates the requirements for buildings and plants with a view to ensure the proper use of land, as well as the beauty, safety and hygiene, of the environment including the protection of nature and cultural heritage. The interests of the population and of the local economy shall be taken in due consideration.

This Act provides the Department of Environment for Northern Ireland with powers to establish and manage protected areas including nature reserves and national parks. It also establishes the Committee for Nature Conservation. The Department may acquire land or enter into a management agreement with land owners for this purpose. This legislation also allows for acquisition of land by the Department. In addition, it states that bylaws can be created to protect such nature reserves. The Order also makes provision for the establishment of marine nature reserves.
