This Act places restrictions on the creation of settlements, trusts and future interests in relation to rights in land and other property.Subject to certain exceptions, the Act prohibits the settlement of property, the limitation of any property in trust for another or any vesting in possession of property at a future date. Exceptions concern, among other things, tenancy for life and tenancy in common. The Act also defines the effects of any dispositions made contrary to this Act.

Article 10 shall be supplemented with paragraph 2 of the following wording: “In case of making purchase and sale contract of land associated with privatized objects or objects subject to privatization, land associated with private enterprises, as well as of land associated with unfinished constructions lease contract previously concluded by the local self-government shall be declared null and void from the moment of entry into force of the aforesaid land purchase and sale contract”.

Paragraph 6 of the Article 6 shall acquire a new wording: “In case of any transaction leading to transfer/acquisition of land ownership right the person who has transferred the aforesaid right shall be considered the payer of single agricultural tax until the last day of the month in which the contract has been concluded while the person who has acquired the right shall be considered payer of single agricultural tax from the first day of the month following the month in which the contract has been concluded”.

This Act amends the Foreshore and Land Reclamation Ordinance, Cap 35 in section 2 by adding definitions and in section 3 with respect to compensation by licence holders to landowners.This amendment is introduced so as to strengthen the recognition of customary rights over the foreshore of lands. Private rights over land expressly include customary rights to the exclusive use of the foreshore of Mauritius lands. Landowners are granted certain rights with respect to the granting of licences for the extraction of materials from the foreshore.

Act establishing the State Fund for Soil Improvement.

This Act sets up the State Fund for Soil Improvement. It also lays down amendments to the the Act on conditions of converting agricultural and forest lands from ownership of the state to other persons and to the Agriculture Law. As from 1 January 2006, the State Fund of Soil Improvement takes over the rights and obligations pertaining to the Ministry of Agriculture in matter of soil improvement.

This Law provides conditions by which compensation for restrictions on economic activities in protected territories established by the State or local governments shall be granted and the procedures for granting such compensation. Compensation granted for restrictions on economic activities in protected territories shall be divided as follows: (a) reimbursement; and (b) exchange of a land parcel situated in a protected territory to an equivalent land parcel owned by the State or local government.

This Regional Law establishes that minimum land area of newly consolidated agricultural land, including reclaimed land, allotted on condition of ownership or lease shall be 5 ha. Maximum land area of agricultural land that can be allotted or purchased by a single citizen and (or) a single legal person shall be determined in accordance with the type of agricultural activity and specified in the Annex to this Regional Law.
