The present Law regulates general rules of transfer of municipal land into ownership, land tenure and lease with the consideration of the particulars of its management, and legal relations in the sphere of its tenure and conservation. The Law consists of 6 Sections that contain 28 articles. Section 1 (arts. 1-5) lays down general provisions. Section 2 (arts. 6-11) establishes the particulars of transfer of municipal land into ownership, land tenure and lease. This Proclamation provides rules relative to the establishment, registration and administration of condominium and related rights. The condominium shall be administered on the basis of a unit owners association, i.e. an association established with a view to obtaining mutual benefits for unit owners other than securing or sharing of profits. Two or more unit owners associations may amalgamate by registering with the registrar the Declaration, description, by-laws and rules for the amalgamated association.

This Regional Law establishes minimum and maximum land areas of plots of land that can be allotted to citizens in ownership out of stock of public or municipal land for farming, gardening, horticulture, stockbreeding and suburban housing construction, including allotment of the aforesaid plots of land free of charge in cases envisaged by Land Code. Maximum land area that can be allotted for farming shall not exceed 10 percent of total available agricultural land area within the boundaries of a municipal unit at the moment of allotment.

This Regional Law regulates ownership on land plots, land tenure and lease, and also turnover of land plots and land shares in common land property related to agricultural land. Land tenure shall be performed in accordance with purposeful use of land, legal regime and authorized land uses in accordance with zoning of the territory. Land tenure must ensure conservation of ecosystems.

This Regional Law determines the particulars of legal relations concerning ownership, tenure and management of agricultural land that shall be based upon the following principle: preferential right of the regional administration to purchase of plots of agricultural land in case of sale thereof except for cases of public auction sale. Minimum consolidated agricultural land plot that can be allotted to natural person shall be 0, 1 ha.

For the purposes of this Act, the objects of common ownership are a plot of land and such parts and equipment of a structure which are not part of the physical share of any apartment ownership and are not in the ownership of a third person. Immovable property ownership the object of which is a plot of land together with a structure or a structure to be built thereon may be divided into apartmentownerships. Apartment ownership is created by entry in the land register.

The Apartment Associations Act provides for differences in legal status, bases of activity and termination of apartment associations. An apartment association is a non-profit association established by apartment owners for the purpose of shared management of the legal shares of the buildings and plot of land which are part of the object of apartment ownership and representation of the sharedinterests of the members of the apartment association.

This Act concerns control of holding of interests in land in Montserrat by foreigners, i.e. a person other than a person who is deemed to belong to Montserrat under the provisions of section 2(2)(b) of the Immigration Act. The Act also provides for forfeiture of land and mortgages held by persons not belonging to Montserrat after commencement of the Act.

This Act applies for an SMBI application and an SMBI request, about development that would not have required a development permit under a superseded planning scheme but requires a development permit under the Redland’s IPA planning scheme and in relation to a class 1 building on prescribed land made by or on behalf of the owner of the prescribed land within 10 years after the day the Redland’s IPA planning scheme has effect and for which the person making the request states the owner wishes this Act to apply.

The present Act provides protection for both parties under a lease or agreement for sale for land where payment is made with the crops grown on said land. In particular, the Act operates when, pursuant to a lease, sale, or first mortgage on a piece of land, there is provision made to pay the rent, purchase money, or mortgage money either in whole or part with crops grown on that land. The maximum amount of any lien or charge which may be charged as a result of the transaction is one third of the value of the crop.

The Act stipulates rules for the creation, enforcement and extinction of real burdens, and special rules for community burdens and manager burdens. A “real burden” is an encumbrance on land constituted in favour of the owner of other land in that person's capacity as owner of that other land. Other burdens regulated by this Act include: Conservation burdens, community burdens, management burdens, rural housing burdens, maritime burdens, economic development burdens, and health care burdens.

The present Regional Law is aimed at ensuring rational use and protection of land, conservation and creation favourable environment for human life and health, protection of the rights of citizens to land, improvement and state regulation of land relations, further development of various forms of economic activity on land and involvement of land into commercial turnover at the regional level. The Regional Law consists of 14 articles. Article 1 establishes plenary powers of the regional Legislative Assembly in the sphere of land relations.
