This Law regulates property relations and classifies the types of ownership in three categories: (a) private; (b) collective; and (c) public. It establishes that the objects of property shall be land, subsoil, water resources, vegetable and animal kingdom. Plots of land and vegetation thereon can pertain to private ownership. Land, subsoil, water, forests and other natural resources shall be public property. Foreign land tenure shall be authorized except for agricultural land and forest land.

Part (4) of the Article 4 shall be supplemented with the wording “for land on which privatized or subject to privatization objects that are not used in the technological processes the established period shall be five years.”

Article 1 shall be amended to add the following wording: “Legal possessor of land: (a) person to whom land area was allotted for payment or ownership right was reinstated by decision of the competent body in the course of land reform and the aforesaid land area was delimited in-situ; and (b) the person that has received land ownership due to right of succession or on other legitimate grounds”.

This Act establishes the National Heritage Fund as a body corporate, defines its functions and provides for its internal organization. The principal object of the Fund shall be to safeguard, manage and promote the national heritage of Mauritius. The Fund shall be administered and managed by the National Heritage Trust Fund Board. The principal functions of the Board shall be to identify sites and to manage national heritage entrusted to it.

This Regional Law regulates allotment of agricultural land parcels pertaining to public or municipal property and establishes minimum and maximum dimensions of the aforesaid parcels. Maximum land area of agricultural land parcel owned by a single natural or legal person shall not exceed 20 percent of the total agricultural land area within the boundaries of a given municipal unit.

The Act provides that all deeds, conveyances, wills and instruments in writing whereby any land or interest in or affecting land other than land registered in accordance with the Registered Land Act, may be affected shall subject to compulsory registration in the Deeds Registry Office. The Minister may exempt certain leases from this requirement.

The Lieutenant Governor in Council may make Regulations for the purpose of prohibiting, annulling or in any manner restricting the taking or acquisition directly or indirectly of, or the succession to, any interest in controlled land (as defined), provided that they do not operate so as to prohibit, annul or in any manner restrict the ownership by a person of interests in controlled land consisting of not more than 2 parcels containing, in the aggregate, not more than 20 acres.
