Indigenous & Community Land Rights

This paper represents part of an area of work in support of enhancing access to land and forest resources in support of rural livelihoods in Mongolia. It is based on learning emerging from an ongoing FAOsupported project called: Support to the development of participatory forest management (TCP/MON/2903).

The present paper seeks to cover the key issues, trends, constraints, challenges, knowledge gaps and policy options on a range of dimensions of land access.

Most of the world’s poor work in the “informal economy” – outside of recognized and enforceable rules. Thus, even though most have assets of some kind, they have no way to document their possessions because they lack formal access to legally recognized tools such as deeds, contracts and permits.

Across rural Africa, land legislation struggles to be properly implemented, and most resource users gain access to land on the basis of local land tenure systems.

This paper represents part of an area of work which analyses access to natural resources in Mozambique. An initial paper examined the extent to which Mozambique’s recent regulatory changes to natural resource access and management have had their intended effects (LSP Working Paper 17: Norfolk, S. (2004).

About 88% of the population is concentrated in the highlands, which constitute less than half of the national territory; here the population density is 141 persons km-2. Agriculture is the main source of livelihood and national income in the country. Over 85% of the population directly depends on it and about half of the GDP is generated from the sector.

Land is the most fundamental resource in any society because it is the basis of human survival. Land is the space upon which all human activities take place and provides continued existence of all life forms and minerals.
