Community Land Tenure and the Management of Community Land in Kenya

Policy Papers & Briefs
Dezembro, 2007
Quênia

A majority of the Kenyan population live in rural areas accessing land and natural resources through customary systems and institutions that operate largely outside the mainstream legal framework of land administration. Although there are clear provisions in the Constitution and the Trust Land Act on management of trust land there appears to be an unwritten policy on the part of government that sees community land as land that is not owned but rather is available for County Councils and government to appropriate through the setting apart procedure

Following the widespread wreckage and loss of life caused by the Indian Ocean tsunami of 26 December 2004, unprecedented efforts where made to restore order and rebuild the lives and livelihoods of the millions affected. A proportion of the reconstruction and rehabilitation effort was focused on environmental rehabilitation and a part of this again on the rehabilitation of coastal trees and forests. Many programmes were implemented during the post-tsunami period to restore coastal trees and forests, and in particular mangrove forests.

Light textured sandy soils are ubiquitous throughout the tropics and constitute an important soil resource on which millions are dependent for their livelihoods. Spanning a range of rainfall regimes from the arid to the humid tropics, they present unique sustainability and environmental challenges to resource managers. Physical, chemical and biological characteristics of sandy soils often act as a severe limitation in crop production.
