Settled Estates Leasing Act.

This Act concerns the lease of settled estates. "Settled estate" is defined in section 2 as "all immovable property and all estates or interests in any such immovable property, which are subject of any settlement". "Settlement" is defined as "any deed, agreement, will or other instrument under or by virtue of which any immovable property or any estate or any interest in any such immovable property stands limited to or in trust for any person or persons by way of succession or for a life or lives, or for a term of years determinable with the death of any person".

Decree-Law No. 38/83 regulating rural land leasing contracts.

In compliance with Act No. 15/II/82 (art. 1, para. 5) of 26 March, and with article 75, paragraph 1, point (f) of the Constitution, the Government of Cape Verde regulates the rural leasing contracts for lands not subject to expropriation, according to the Agricultural Reform Act. It also regulates rural sharecropping and rural land leasing which remain temporarily in force in compliance with articles 9 and 23 of the aforementioned Act. This Decree-Law is divided into 9 chapters concerning conditions, terms and requirements for obtaining such leasing contracts.

Act No. 9/II/82 on the Agricultural Reform.

This Act establishes the general bases of the Agricultural Reform. The first part deals with a historical view of Cape Verdean life illustrating the different and traditional ways of exploiting agriculture, livestock and all other resources. The Act establishes the bases for the organization and accomplishment of the agricultural reform.

Law No. 17 of 1974 on the management of public land.

This Law is composed of 22 articles: management of public land is to be entrusted to the Director-General of Land Department (art. 3); competencies of Public Land Committees (art. 5); recommendations for land tenure and rent will be promulgated by the High Committe (art. 6); public land lease is to be authorized by the Minister of Finance (art. 7); leasing priorities: agriculture and housing (art. 8); the implementing regulations will be promulgated by the Cabinet (art. 19); Laws Nos. 14 of 1972 on forest reclamation and No. 9 of 1968 are now abrogated (art. 20).

Occupiers' Liability Act.

This Act defines the liability of an occupier of premises for injury to persons or damage caused to goods and resulting from actions or omissions of the occupier in respect of the occupied property. The Act also defines the liability of a landlord under the obligation of maintenance or repair of the occupied property.

Limitation of Actions Act.

This Act provides with respect to limitation of judicial action in relation with land-related rights. Actions include the recovery of land, rent or mortgage. The Act also concerns rights of tenants and the acquiescence of boundaries.

Law No. 10 on public and private State lands.

This Law is composed of 4 Chapters divided into 25 articles. Chapter I deals with definitions and terms and defines the steps for the concession and exploitation of State lands. Chapter II provides for the definition of private State lands, concession rights, exploitation rights, ownership transfer and land leasing. Chapter III contains offences and penalties. Chapter IV gives general provisions necessary for the issuance of resolutions and regulations for the implementation of this Law.
