This Act: confers powers upon the President of Kenya to grant title or other rights in Government lands; provides for the appointment of a Commissioner of Lands and such other officers as may be necessary for the administration of this Act; and defines procedures and other requirements such as registration in respect to grant of title or other rights in Government land.The Act consists of 146 sections divided into 11 Parts.The President may make grants or dispositions of any estates, interests or rights in or over unalienated Government land in accordance with section 3. The powers of the President are delegated in specified cases to the Commissioner of Land appointed under section 5. Government land may be subdivided and granted in lease, or be subject to a licence for the right of occupation or an agreement of purchase. Sections 19 to 33 concern the disposal of land for agricultural purposes. In normal circumstances, there shall be implied in every lease for agricultural purposes a covenant relative to the development of farms (sect. 33). A conveyance, lease or licence under this Act shall not, unless otherwise expressly provided therein, confer any right to the water of any spring, river, lake or stream, other than to such water as may be required for domestic purposes upon the land sold, leased or occupied under the licence. Other reservations, rights and duties in relation with the grant of title or other rights over Government land are defined in this Act.
