This publication explores various aspects of the interface between water rights and land tenure. It is intended to synthetize and assess current learning on this topic, to define salient issues and to propose fruitful approaches for further investigation.

This paper was prepared as a Background Paper for Chapter 2 of the International Fund for Agricultural Development’s 2009 Rural Poverty Report. It begins by providing an overview discussion of the diversity of natural resources in developing countries, and rights of access, tenure and governance relevant to the rural poor, who are disproportionately dependent on natural resources.

Land Tenure Working Paper 11. This co-publication of FAO and UN-HABITAT seeks to better understand and define the processes, mechanisms and institutions of governance of tenure in rural and urban areas. The paper recognises that excellent land policies, laws and technical reforms have been developed. However, in many cases their implementation has slipped, stalled or even been reversed. By adopting a governance and political economy perspective, the paper offers insights for the design of reforms and for the development of land governance tools.

This guide is written for people who work in land administration and all those with an interest in land, land tenure and their governance. Although much has been written about the importance of good governance in achieving development goals, there is comparatively little material on good governance in land tenure and administration. Failings in governance have adverse consequences for society as a whole. By contrast, good governance can help achieve economic development and the reduction of poverty. Good governance matters.

The Review of the legislative framework and jurisprudence concerning the right to adequate food in Nepal discusses overarching aspects of Nepalese law and jurisprudence dealing with the human right to food. Following a brief discussion of the international legal protection of the right to food in Nepal, the review, in particular provides a critical assessment of constitutional as well as legislative provisions and offers a thorough analysis of Supreme Court jurisprudence pertaining to the right to food.

Ensuring equal rights in ownership and control over land for women and men is essential to achieve gender equality (SDG5) and eliminate poverty (SDG1).

Durant l’Année internationale de la montagne en 2002, la FAO et ses partenaires ont lancé une évaluation à grande échelle et un examen mondial de l’état actuel et des tendances futures de l’aménagement intégré et participatif des bassins versants. The articles in this volume supplement FAO Land Tenure Studies 10, Compulsory acquisition of land and compensation. The latter publication explains what compulsory acquisition and compensation are and what constitutes good practice in this area. This current volumes introductory article provides an overview of these issues. The issue of compulsory acquisition from a human rights perspective is also addressed here as are the concepts of market value, compensation value and just terms compensation.
