The Regulations provide in detail for Grants, licences and permissions (application, renewal, transfer, reversion) (Part I), Surveys (II), Sale of preferential claims in case of plurality of applications (III), Grants to small cultivators (IV), Leases (for agricultural and grazing purposes) (V), Permissions for grazing areas on the pasture lands of the interior (VI), Licences of Occupancy (VII), Licences to cut wood (VIII), Licences to collect balata, gums etc. (IX), Licences for quarrying stone, gravel, kaolin and other clays (X), Miscellaneous provisions (XI).

The Regulation provides for detailed regulations on the lease of beaches, islands, pastures, and places where liquorice is grown by public auction. It contains rules concerning, inter alia, the approval of the Minister, the conditions of the lease, procedures of the auction, setting of rent. (14 sections)

Cette ordonnance fixe le régime foncier et domanial au Togo. This Act provides for the establishment of an Agricultural Development Authority as a body corporate for the area described in Schedule 1. The principal tasks of the Authority are in the field of land regulation, land irrigation and drainage. The 40 sections are divided into 9 Parts: No title (sects. 1 and 2); Establishment and functions of the authority (sects. 3-5); Relationship with other agencies (sects. 6-14); Land provisions (sects. 15-20); Cooperative societies (sect. 21); Environmental protection (sect. 22); Operation, maintenance and management (sects.

The aim of this Act is to re-establish protected areas on land previously owned by agricultural cooperatives before privatization. This goal is achieved through: expropriation, if the area has already been assigned to a private owner; or by not assigning such lands to private owners. Paragraphs 2-4 deal with cases in which expropriation is not obligatory and with cases in which compensation should be paid to the owner. Expropriation should be carried out, at the latest, within 3 years from the entry into force of this Act.

Cette loi définit la composition du domaine national ainsi que les règles de sa constitution, de sa gestion et de contrôle de son utilisation. Elle comprend 140 articles répartis en 3 parties principales, à leur tour comprennant plusieurs titres.

Ce décret détermine les conditions d'évaluation des prix de cession des terrains faisant partie des réserves foncières communales. Ces conditions sont: le prix d'aquisition du terrain, les charges constitutives du coût d'aménagement et le taux de la marge d'intervention de la commune, fixé à 7 pourcent et à 3 pourcent si la cession est au profit de l'Etat.

Cette ordonnance organise le territoire national en 30 provinces, trois cents départements et cent huit communes et porte leur organisation administrative et leur régime juridique.

The Act provides for a system for the disposal of national lands, i.e. lands held by the Government. National lands can be disposed of through lease (sect. 7) or sale (sect. 13). Leases are granted against payment of rent, arrears of which are recoverable in court (sect. 10). Applicants for leases in excess of 500 hectares must file an Environmental Impact Assessment, prior to the grant and every five years thereafter. The Minister has authority to impose this same requirement on applicants for leases covering a lesser land surface (sects. 9(4) and (5)).

This Law concerns the formation, organization, preservation and use of nature reserves. There are four types of reserves: (i) state conservancies, where most human interference is prohibited; (ii) national parks, where activities are somewhat less restricted and which are intended for recreational, historical, cultural and scientific purposes; (iii) state reserves, the characteristics of which are not specified; and (iv) natural monuments, which are natural objects of special scientific and historical cultural value.
