Amendment of the Law on Preserving the Land Use of Farms and Gardens.

This Law, which consists of 8 articles, is codified to amend and add a number of supplementary provisions to the Law of 21 June 1995 on Preserving the Land Use of Farms and Gardens. The main rules of the afore-mentioned Law on Preserving the Land Use of Farms and Gardens remain unchanged and some detailed regulations have been amended or added by this Law. In particular, the Law adds 6 articles (articles 7 to 12) to the said Law. Accordingly, providing that any public service and infrastructure in farms and gardens may be allowed only after official authorization for land use change.

The present Law regulates the implementation of the Federal Agricultural Lease Act of 4 October 1985, the Agriculture Act of 29 April 1998 and the Federal Soil Act of 4 October 1991. The purpose of the present Act is to enforce and complete the federal legislation on agriculture and rural soil, to ensure favourable conditions and to promote an environmental-friendly management.

This Decision approves the master plan on the socio-economic development in the northern midland and mountainous region through 2020. These Regulations establish an action programme for nitrate vulnerable zones, implementing the requirements to establish such a programme in Article 5 of Council Directive 91/676/EC concerning the protection of waters against pollution by nitrates from agricultural sources. Regulation 3 requires the occupier of a farm or livestock unit all or part of which is in a nitrate vulnerable zone to ensure that the action programme set out in the Schedule to the Regulations is implemented in relation to the farm or livestock unit or to that part of it which is in the nitrate vulnerable zone.

These Regulations supplement Council Regulation (EC) No. 2078/92 on agricultural production methods compatible with the requirement of the protection of the environment and maintenance of the countryside. They include provisions to meet the requirements of Commission Regulation (EC) No.746/96 laying down detailed rules for the application of the Council Regulation. Commission Decision C(99)15 of 29th January 1999 approved in part the agri-environmental programme entitled "the Countryside Management Scheme" to which these Regulations give effect.

Regional Law No. 119-ZRH “On minimum and maximum agricultural land plots pertaining to public or municipal ownership that can be allotted to peasant farms”.

This Regional Law establishes that minimum agricultural land plot pertaining to public or municipal ownership that can be allotted to peasant farms shall be 2 ha, while maximum agricultural land plot pertaining to public or municipal ownership that can be allotted to peasant farms shall be 300 ha”.

This Regional Law establishes that public or municipal land plot can be allotted free of charge on condition of tenancy for maximum period of six year for family farming. It lists municipal districts eligible for distribution of agricultural land plots in accordance with the aforesaid terms and conditions. After five years of tenancy the aforesaid plots of land can be transferred to peasant farms in ownership free of charge upon submittal of written application by tenants.
