These Regulations amend the Organic Farming Regulations (Northern Ireland) 2008 by amending the interpretation of “the Council Regulation” to take account of the introduction of Council Regulation (EEC) No 834/2007 of 28 June 2007, which repeals and replaces Council Regulation (EEC) No 2092/91.

The present Regulations are made under the Saskatchewan Farm Security Act which affords protection to farmers against loss of their farm land. The purpose of this Order is to compensate for the subsidy for marginal zone areas which are utilized for agriculture and that are eligible to the Single Payment Scheme and land with trees. In order to eligible, the areas must be located within one or more fields where there is an overlap of at least 100 meters between each field and the border zone areas with the same contribution rate.

These Regulations provide for the payment of grant to farmers who enter an agreement with the Department of Agriculture and Rural Development to carry out approved agricultural operations under these Regulations. Grants are made in the framework of the Northern Ireland Rural Development Programme. “Approved operations” are agricultural operations approved by the Department other than those carried out in pursuance of an agreement with the Department under the Organic Farming Regulations (Northern Ireland) 2008.

These Regulations provide for the payment of grant to farmers who agree to introduce organic farming methods and comply with the management requirements and standards of good agricultural and environmental condition provided for in Articles 4 and 5 of and Annexes III and IV to Council Regulation (EC) No 1782/2003. Grants shall be paid to farmers who are certified by an organic inspection authority as having agreed to a plan to convert all or part of their holding to organic farming methods.

The Decree provides the allotment of state-owned land destined to planting of perennial trees, seasonal crops and forestation, plus the water surface required for aquaculture farming to individuals, households and organizations which shall invest in the resulting production. Planning and financial evaluation of production costs shall be prepared and funds destined to support all agricultural, forestry and aquaculture activities and operations.

This Regional Law establishes cases of allotment of land parcels, pertaining to public or municipal property, in ownership free of charge, and also maximum land parcel areas authorized for transfer in ownership to citizens. Public and municipal land parcels can be transferred in ownership to citizens once-only for the following purposes: (a) gardening and horticulture; (b) farming; and (c) individual housing construction.

El presente Decreto modifica el Reglamento a la Ley que tiene como objetivo su correcta aplicación para la preservación del uso de los terrenos dedicados a actividades de producción primaria agropecuaria, para que se incluya la definición de Áreas de conservación y protección, que son todas aquellas partes o secciones de terrenos de un bien inmueble de uso agropecuario primario con límites definidos dedicados a la protección de los acuíferos, la protección ambiental, la regeneración natural del bosque o donde se han sembrado árboles con fines de protección.

These Regulations comply with Council Regulation (EC) No. 2078/92 on agricultural methods compatible with the requirements of protection of the environment and the maintenance of the countryside. They allow the Minister of Agriculture to make payments to farmers in nitrate sensitive areas. The nitrate sensitive areas are defined in maps deposited at the Ministry of areas listed in Schedule 1. Schedule 2 sets out undertakings concerning mainly the application of nitrogen fertilizer which a farmer must give for at least five years in all cases in order to be eligible for aid.
