La présente loi, en complément aux dispositions des articles 19, 20, 21, 25, 34,43 et 54 du dahir du 12 aout 1913 sur l’immatriculation foncière, autorise le conservateur de la propriété foncière de déléguer aux fins d'exécution des opérations de bornage, certaines charges à un géomètre topographe.

The present Act ensures the survey of land and the approval of plans. The Act contains at the outset a definition clause relating to various terms employed therein such as, for example, “application for boundary confirmation”, “cadastral parcel mapping system”, “deteriorated monument”, “former land registration district”, “land surveys directory”, “land titles registry”, “lost monument”, “parcel”, “primary survey”, “registered owner”, “re-establishment”, “Registrar of Titles”, etc. Section 4 establishes the Land Surveys Directory.

This Act provides for the validity of mortgages or charges made in Kenya by delivery to a person or his agent of a document or documents of title to immovable property, with intent to create a security thereon. Such mortgages shall not be invalidated by section 59 of the Transfer of Property Act, 1882, of India, as applied to Kenya.

Land Adjudication Act (Cap. 284).

This Act makes provision for the administration of the adjudication of any area of Trust land designated by the Minister. The Minister may designate, by Order, Trust land to which provisions of this Act apply if: (a) the county council in whom the land is vested so requests; (b) the Minister considers it expedient that the rights and interests of persons in the land should be ascertained and registered; and (c) the Land Consolidation Act does not apply to the area.

The present Act lays down provisions relating to possibilities on behalf of land owners to enter an agreement with the competent land authorities of British Columbia to obtain postponement of the payment of land tax. Section 2 establishes that the Minister may make an agreement with an owner who qualifies under this Act permitting the owner to defer paying all or part of the tax payable on the eligible property during the term of the agreement.

This Regional Law regulates relations in the sphere of conservation, management , promotion and state protection of the objects of cultural heritage and is aimed at ensuring constitutional right of citizens related to access to cultural heritage. Objects of cultural heritage shall be considered immovable property and shall include natural landscapes, recreational urban forests and parks. Land within the boundaries of territories of cultural heritage recorded in the public register of the objects of cultural heritage shall be considered land of historical and cultural heritage.

This Act is divided in three Parts. Part One deals with Introductory Provisions and, in particular, with the electronic processing of records and data, and sets out the principles of real estate registration. Part Two regards the system of real estate registration and it has three Chapters determining the contents of real estate registers and the method of registration. Part Three consists of five Chapters which regard registration proceedings, legal remedy, use of data from real estate registers, rules on special procedures, and closing provisions.

This Regional Law regulates the issues of preparation, elaboration and location of plots of land on cadastre scheme or cadastre map on the respective territory. It shall be applicable to: (a) public or municipal land allotted for housing construction; (b) public or municipal land destined for sale; (c) public agricultural land allotted for peasant and family farming. Cadastre scheme shall contain boundaries of plots of land, land area, location and “validated” print.
