In Mozambique, changes in land access and use are shaping new landscapes, often at the expense of the poor. Despite progressive land legislation, elite groups and vested interests are consolidating land holdings while peasant producers are being dispossessed of their land and access to fertile plots is becoming increasingly difficult. As national and foreign investors seek land for housing, real estate, agriculture, tourism, mining and forestry, what is the state’s role in responding to these increased demands?

Legal limits to tribal governance: coal mining in Meghalaya, India

Land in Meghalaya, India, was traditionally agricultural land, owned by the community. With increasing privatization and rising commercial value of land for non-agricultural use, many owners have sold the land for mining operations. So-called rat-hole coal mining has resulted in environmental degradation as well as in the loss of lives of miners, most of whom are from outside the state. The National Green Tribunal has banned coal mining until safer, more environmentally sound policies and practices are in place.

Mutual suspicion has characterised the relationship between the South African government and mining companies, particularly in recent years. Resolving the current impasse would require a panoply of policy interventions because of the complexity and age of the mining industry. This briefing proposes that one such intervention could be the introduction of a structured workplace secondment programme between the Department of Mineral Resources (DMR) and mining companies – together identifying critical areas for co-operation and skills transfer.

In the Southern African region with its rich mineral deposits, this trend has added importance. Mining companies extract minerals from the ground, and their activities routinely give rise to public concerns about the pollution of water sources, adequate land for agriculture, and fair community participation in mining projects.

Disputes over land and water rights in gold mining : the case of Cerro de San Pedro, Mexico

This article analyzes different visions and positions in a conflict between the developer of an open-pit mine in Mexico and project opponents using the echelons of rights analysis framework, distinguishing four layers of dispute: contested resources; contents of rules and regulations; decision-making power; and discourses. Complexities in this study manifest how communities’ land and water rights are circumvented by governmental bodies and ambivalent regulations favouring the large mining company. This process is importantly reinforced by international trade legislation.

The « Environment and Natural Resources Code of Cambodia » (Sixth Draft – – 20 November 2016) is a very extensive proposed law (535 pages !) which will have, if adopted, major impacts on many aspects of Cambodian development (Mines, Energy, Urban planning, etc..) but is particularly important for the management of Protected Areas and of Forests and Fisheries. The code has been elaborated by a panel of experts and several working groups led by Vishnu Law Group. A public national consultation has been organized by MOE in Dec 2016.

Obedeciendo a la división internacional del trabajo, los usos hegemónicos del territorio a menudo funcionan como modalidades de acumulación por desposesión. Tal es el caso del actual boom de la minería metálica en la Argentina. El objetivo de este trabajo consiste en demostrar que la minería metalífera de la Provincia de Jujuy se ha desarrollado, desde sus orígenes hasta la actualidad, como un uso del territorio asociado a diversas formas de acumulación por desposesión.
