This Law regulates the functioning of local government related to urban and rural administration, defining plenary powers thereof and its relations with other state bodies. Local government shall be guided in its activity by jurisdictional competence, legality, collegiality and transparency. Information related to decisions taken by local government shall be made generally available. The sphere of competence of the local government shall include rational use of natural resources, environmental protection, land-use planning and urban and peri-urban agriculture.

No person shall occupy or use more than three acres of land for urban farming. No person shall, except where that person practices zero grazing, graze his animal in an urban area (reg. 3). "Urban farming" means the carrying out of plant or animal husbandry activities as set out in the Schedule within statutory township boundaries. Urbanisation and economic transformation - the growth of non-farm, industrial and service sectors - offer many opportunities for improvements in poor people's lives.The crucial challenge is to ensure that places work better for people, providing an enabling and supporting environment for changing livelihoods and economies. But all too often there is a failure to recognise and manage the urban transition, resulting in the continuing urbanisation of poverty, vulnerability and exclusion.

Although «urban» and «rural» development are often considered as in opposition to each other and seen as competing with each other for investment and support, many urban centres owe much of their economic base to agriculture. Ironically, one of the best tests of whether rural development is working is whether local urban centres are booming - as increasing agricultural output is served by markets and producer services there, and as real increases in income for a wide range of rural households are reflected in increased demand for goods and services provided by urban-based enterprises.

The relationship between urban and rural areas has undergone great change in recent years. It is now often difficult to clearly define the borders between the two; instead we find a continuum ranging from agricultural zones to suburbs, informal settlements and urban centers. But do countries and development cooperation policies have the instruments needed to promote a dynamic and balanced development of urban and rural areas and open up opportunities for the people who live there?

Agricultural value chains link urban consumption with rural production. Changing demand, as a consequence of urbanization, emergence of «modern» consumption patterns or new trends in international trade, impacts on rural areas along value chains and spills over to marketing and production systems.These rural urban linkages bear challenges but also mutual benefits for producers and consumers and can be promising entry points for development interventions.This is illustrated with the case of the Kenyan potato value chain.

This Decree establishes the modalities of cadastre valuation of agricultural land and updating its data related to plots of agricultural land allotted for urban and peri-urban agriculture to horticulture and gardening cooperatives, and also the land or urban areas. Cadastre valuation of agricultural land shall be conducted on 1 July of the year of performance of cadastre valuation. Cadastre valuation of the aforesaid land categories shall be performed by initiative of State Property Committee at least once in 4 years.

Article 1 shall be amended to add the following wording: “This Regional Law establishes maximum and minimum land areas of land plots destined for consolidation and allotment in ownership to citizens for gardening, horticulture, urban and peri-urban agriculture and stockbreeding out of stock of public and municipal land that has no land-use planning documentation for construction purposes by the date of 1 March 2015”.
