WASHINGTON, 22 juillet 2013—L’Afrique possède près de la moitié de toutes les terres utilisables non cultivées de la planète. Ce sont environ 202 millions d’hectares qui pourraient être ainsi exploités. Elle affiche pourtant le niveau de pauvreté le plus élevé du monde. Ses piètres performances sur le front du développement suggèrent qu’elle n’a pas tiré parti de ses abondantes terres agricoles et ressources naturelles pour enclencher une croissance partagée et soutenue.

Intensifier les progrès

En 2009, l’UE s’est fixé comme objectif de porter à 10 % la part des énergies renouvelables dans sa consommation énergétique d’ici 2020. Dans le secteur des transports, cela s’est traduit par une législation qui promeut l’utilisation des carburants d’origine végétale : les agrocarburants.

El citado Digesto refleja los debates y problemas jurídicos que han tenido que resolver los jueces ante el alto número de conflictos sociales relacionados con la propiedad de la tierra, el territorio y los recursos naturales de los pueblos indígenas.

El tema de los límites a la propiedad, o más precisamente del establecimiento a través de la ley de límites máximos a la propiedad de la tierra agrícola ha retomado actualidad en los últimos meses en el Perú. A la fecha se han presentado hasta tres propuestas legislativas al respecto, no obstante es necesario revisar algunos antecedentes antes de pasar a las propuestas mismas.

El autor plantea un análisis a la problemática de acceso a la tierra desde el ejemplo sucedido en la Provincia de San Juan en Argentina. La falta de reconocimiento de la propiedad de las tierras ancestrales para con los pueblos originarios causa conflictos con compradores que recurren al desalojo y al avasallamiento para obtener la tierra. Por su parte, las comunidades usan todos los medios posibles para defender su tierra de origen. El IPDRS se complace en presentarles el artículo 176 de la serie Diálogos  que nos muestra un caso de acceso y lucha por el territorio.
 

Preamble of Land Act: "Whereas, legislative reforms initiated from the Golden Throne have resulted in enactment and amendment of many laws for the benefit of the people of Bhutan, the Land Act of Bhutan shall stand testimony to the continued commitment and diligence of the Druk Gyalpo in his pursuit to promote the well-being of the Bhutanese people.

Article 2(1): 

"1. Civil legislation is based on the recognition of the equality of the participants of the relations regulated thereby, inviolability of property, freedom of agreement, prohibition of arbitrary interference in somebody's private affairs, indispensability of the free exercise of civil rights, and provision for the restitution of violated rights and their defence in the court."

The objectives of this sub-decree are to determine the criteria, procedures, mechanisms and institutional arrangements for initiating and granting new economic land concessions; for monitoring the performance of all economic land concession contracts; and for reviewing economic land concessions entered into prior to the effective date of this sub decree for compliance with the Land Law of 2001."

To provide for the expropriation of property for a public purpose or in the public
interest, subject to just and equitable compensation; and to provide for matters
connected therewith.

Land disputes are threatening the prospects of post-war reconstruction in Afghanistan. Population growth, returning refugees, opium poppy production, ethnic tension and drought have increased the pressure on the land. A growing number of rural Afghans are either landless or own plots too small for survival. Competition over pasture is leading to armed clashes between nomads and settled farmers. Neither the Karzai government nor the international community is doing enough to restore order to land relations.
