This is a piece of general property legislation, regulating the transfer and disposition of property, interests and rights.

This Act specifies the terms of contracts for land transfer (lease, mortgage, sale) annexing the forms in 6 Schedules. The Ordinance is divided into the following Parts: Preliminary (I); Country Lands (II); Town Lands (III); Native Lands (IV); Registration (V); Part VI has been repealed; Collection of Land Revenue (VII); Demarcation and Survey (VIII); Trespasses and Penalties (IX).The entire property in and control of State land or land reserved for a public purpose is vested in the Government. Subject to any general or special direction of the Minister, the Director of Lands and Surveys may alienate State land, according to the terms and conditions established in this Ordinance.

El presente Reglamento, que consta de 8 capítulos, 68 artículos, 2 disposiciones especiales, 3 transitorias y 1 final, dispone que el otorgamiento de tierras eriazas compete al Ministerio de Agricultura (art. 2º) y está condicionado a la existencia de aguas de libre disponibilidad, debiendo tramitarse el otorgamiento para el uso de dicho recurso en el mismo expediente que origina el pedido de tierras (art. 3º).

This Act provides for the use of public uncultivated lands. It consists of 42 articles specifying the requirements to be met in order to exploit these lands, establishing the conditions for land expropriation, concession, use, etc. It lays down duties, competencies and composition of national administration responsible for the management of these lands, fees to be paid, land lease, etc.

The Regulation is made under the Land Proclamation No. 58/1994. It sets out the procedure for the allocation and administration of land and applies to all types of urban and rural land. Land shall be allocated for tiesa, agricultural usufruct or leasehold, on the basis of a master plan. To ensure these rights, right holders shall be given an allocation certificate or lease agreement. To prevent allocation of land to holders with the sole aim of holding land idle, the size of land to be allocated shall be proportionate to the planned aim (art. 3(4)).

This Proclamation makes provision for the registration of land and other immovable property. It provides for the establishment of a Cadastral Office, for the registration of all land, rights over land and duties that emanate from such rights, and the transfer of property through sales, donation, succession or other manner. The registration system shall use the application forms and certificate pursuant to Legal Notice No. 31/1997. On the basis of the abovementioned documentation, the Cadastral Office shall keep a map or plan that clearly shows parcel features and boundaries.

This Act concerns Agrarian Reform. It consists of 51 articles laying down general principles in order to manage this sector: land expropriation requirements, agricultural land use, land rights, land concession, lease, etc.
