Desde los años 80 diversos proyectos de exportación de agua en grandes cantidades han sido concebidos tanto en Estados Unidos como en Canadá dada la abundancia del agua en la región de los Grandes Lagos de Norteamérica y las frecuentes declaraciones de estados de sequías intensas en el suroeste americano.Desde que se firmó el Tratado de libre comercio de Norteamérica, se plantea que el agua fue incluida como cualquier otra mercancía y el temor de los gobiernos de perder el control del recurso aumentó considerablemente.

El artículo analiza y sistematiza algunos aspectos de doctrina judicial relativos a los criterios para determinar la relación que existe entre el derecho al agua y saneamiento como derecho humano, los principios y reglas propios que distinguen la prestación de este tipo de servicios públicos, y los conflictos aún irresueltos en torno al efectivo acceso a la defensa judicial de derechos colectivos e intereses individuales homogéneos involucrados.
