The President may authorize land reclamation by owners of land bordering the foreshore. Before authority is granted the procedure as set out in the First Schedule shall be followed as far as possible. Any reclamation authorized shall be carried out by and to the complete satisfaction of the Director of Public Works. These provisions shall apply also to the Crown where the foreshore borders form part of the domaine public. The reclaimed land shall become property of the Crown as part of the domaine privé.

Coast Reserves and Foreshore Leases Act (Cap. 36).

This Act grants the power to the President of Seychelles to grant leases to the owners of islands or parts thereof and to lessees of State lands in Seychelles of the reserves along the seacoast. Leases shall be granted for not more than ten years but may be renewed for further periods of ten years. Leases shall be granted at conditions as the President may deem fit provisions, article 538 of the Civil Code notwithstanding.

This Act makes provision for the establishment of the Coast Development Authority of Kenya and defines its powers, functions and internal organization. The Act consists of 17 sections divided into 5 Parts.The Coast Development Authority is established as a body corporate and shall be composed of Government officers, the Provincial Commissioner for the Coast Province (“Area”) and representatives of the area affected by the operations of the Authority. The Authority shall be responsible for the development of the Area and for this purpose shall draft a development plan.

Digging, taking, carrying away or aiding or assisting in digging, taking or carrying away any sand, stone, shingle or gravel from any beach or seashore in Grenada without the permission of the Permament Secretary of the Ministry of Communication and Works is declared to be an offence (sect. 3). The Minister may, by Order, declare that this Law does not apply to a specified beach (sect. 4). If a vehicle is used in acts under section 3 the driver of the vehicle shall be guilty of an offence (sect. 5). Persons acting in contravention of this Law may be arrested without a warrant (sect. 6).

This Act makes provision for the protection of the foreshore. It places restrictions on the removal of sand, stones, shingle or gravel from a beach and the fouling of the seashore. Removal of material with a motor vehicle requires a permit issued by the Permanent Secretary to the Minister responsible for beach protection matters and works or by any person acting under his or her authority and shall be subject to such terms and conditions as are stipulated in the permit.

This Law amends Law No. 27/2007 on the Management of Coastal Area and Isles. Amendments deal with several articles specifying administrative and legal proceedings for managing coastal areas and small islands meeting environmental requirements for the following purposes: conservation, education and training, research and development, mariculture, tourism, environmentally friendly fisheries and maritime business and fishery industry, organic agriculture, husbandry, state defense and security.
