This brief explores the reform of land tenure institutions which re-emerged in the 1990s, and asks if these reforms are any more gender sensitive than those of the past?The paper highlights that a focus of the recent reforms has been on land titling, designed to promote security of tenure and stimulate land markets. The reforms have often been driven by domestic and external neoliberal coalitions, with funding from global and regional organisations which have argued that private property rights are essential for a dynamic agricultural sector.

Contending Views and Conflicts over Land in the Red River Delta since Decollectivization is an anthropological study in which I offer a new approach exploring the viewpoints of various parties to analyze their attitudes, relations and conflicts over land in Vietnam's dynamic Red River delta after decollectivization. I also evaluate how and in what ways industrialization and modernization, as well as the effects of urbanization, marketization, and to a lesser extent globalization, have affected Red River Delta villagers' views and relations towards agricultural land.

The legal framework for land use planning and land allocation (LUP/LA) in Lao PDR has been analysed based on the relevant laws (Land Law, Forest Law, Agricultural Law etc.). A national LUP/LA program under the overall responsibility of the Ministry of Agriculture and Forestry has been created in 1996. Until 2003, district agricultural and forestry staff have conducted LUP/LA activities in a total of 5400 villages in all provinces of Lao PDR. It is estimated that approximately 300.000 Temporary Land Use Certificates have been issued as a result of LUP/LA.

Includes experience with land policy development in the region, the Malawi National Land Policy and its implementation strategy, the emerging land market, social protection and economic growth and DFID’s support to date. Among the options suggested to DFID are a more inclusive project, low cost strategic engagement or withdrawal from the land sector. Argues the need for DFID support for public information and awareness and for civil society organisations. Contains a draft legal brief on customary title in Malawian law as an annex.

Includes a retrospective of 10 years of land reform, restitution, redistribution, farm tenure reform, communal tenure reform, debating the future of land and agrarian reform, conclusions. Argues that there is a need for the state to intervene to make suitable land available to meet local needs, rather than relying wholly on land markets.

This report is the first in a series of research studies that the Economic Commission for Africa (ECA) will produce with a view to improving the understanding of the links between land tenure systems and sustainable development in Africa. In a continent where 80 percent of the population relies on agriculture for their livelihood, the formulation and implementation of appropriate land policies is a paramount factor in poverty reduction strategies. Research is therefore needed to help policymakers take learned decisions when addressing land tenure issues.

While Vietnam's reforms provided some of the weakest legal private property rights amongst the transitions countries, cities like Ho Chi Minh City have booming domestic real estate markets. Interestingly, while most properties in 2001 did not have legal title, those on the market did advertise a variety of property rights claims. Employing a hedonic price model to analyse the pattern of prices at which sellers offer properties in Ho Chi Minh City, this study examines how this market values property rights.

Effective land policy reform is strewn with complexities and pitfalls. The paper focuses on land tenure, access and use in rural settings, and suggests that Latin America is home to some worrisome trends as well as the rich array of initiatives on land issues. By surveying the literature and examining the issues this study points to areas needing attention from researchers and policymakers.
