Palm oil production is currently the focus of much contentious debate. On the one hand, palm oil production has a substantial, positive (socio-) economic impact in countries which produce it, like Indonesia, and is a powerful engine of rural development. On the other hand, palm oil production has a severe negative impact regarding ecological and social sustainability. This is due above all to its large carbon footprint, reduced biodiversity, and its potential for triggering land rights conflicts.

The Farmland Law and the VFV Law were approved by Parliament on March 30th, 2012. There have
been a few improvements compared to previous laws such as recognition of
non-rotational taungya as
a legitimate land-use and recognition that farmers are using VFV lands without formal recognition by
the Government. However overall the Laws lack clarity and provide
weak protection of the rights of
smallholder farmers in upland areas and do not explicitly state the equal rights
of women to register

No protection for taungya farmers in bylaws: experts

A network of land-focused civil society organisations has raised concerns that bylaws for two new pieces of land legislation fail to offer proper protection for upland farmers who use shifting cultivation, leaving millions at risk of losing their land tenure rights.

Land Core Group chairman U Shwe Thein said that the recently introduced bylaw for the Farmland Law interprets taungya, or upland farming, as only fields under permanent cultivation. This leaves farmers who practise upland shifting cultivation with little protection from losing their lands...

Vietnam's rapid and sustained economic growth and poverty reduction in the last two decades benefitted from the policy and legal reforms embodied in the Land Laws of 1987, 1993 and 2003 and subsequent related legal acts. This note outlines reforms related to four main themes. The first relates to the needed reform for agriculture land use to create opportunity to enhance effectiveness of land use as well as to secure farmers' rights in land use. Prolonging the duration of agricultural land tenure would give land users greater incentives to invest and care for the land.
