Regional Law No. 172-ZO “On conservation of agricultural soil fertility through biologization”.

The scope of this Regional Law shall be to ensure reproduction of agricultural land fertility through biologization of arable farming by land owners, land tenants, including lease holders. Owners, tenants and lease holders of agricultural land shall have the following rights: (a) carry out phytoagrotechnical, phytosanitary, land reclamation and anti-erosion arrangements; and (b) have access to information related to soil fertility managed by state bodies.

Regional Law No. 99-ZO “On maximum land areas allotted in ownership to citizens”.

This Regional Law establishes maximum land area of land parcels allotted in ownership to citizens free of charge as follows: (a) for peasant farms – 8 ha; (b) for gardening – 0,10 ha; (c) for horticulture – 0,10 ha; for suburban housing construction – 0,04 ha; (d) for subsistence farming – 0,15 ha; and (e) for individual housing construction – 0,15 ha.

This Act amends Sisal Industry Act, 1997, the Tea Act, 1997, the Courts (Land Disputes Settlements) Act, 2002 and the Tanzania Food, Drugs and Cosmetics Act, 2003. The Sisal Industry Act, 1997 is amended in the Schedule regarding the membership of the Tanzania Sisal Board. The Tea Act, 1997 is amended in Schedule regarding the membership of the Tea Board of Tanzania. The Courts (Land Disputes Settlements) Act, 2002 is amended in section 25 with respect to the appointment of the Chairman of the District land and Housing Tribunal.

This Law establishes legal, organizational and socio-economic grounds for the institution, functioning and re-organization of peasant farms. It shall not be applicable to subsidiary small-holding, collective gardening or horticulture. Peasant farm shall be considered individual enterprise based upon private ownership of agricultural land and individual work of household members for primary processing and trade of agricultural commodities.

Regional Law No. 220-OZ “On rates of land allotment”.

This Regional Law establishes rates of land allotment to citizens into ownership for agricultural purposes and maximum land areas to be allotted thereto. Maximum land areas shall be established as follows: (a) for gardening – 0,50 ha; (b) for horticulture and vegetable growing – 1,00 ha; (c) for stockbreeding – 1,00 ha; (d) for suburban housing construction – 0,25 ha; and (e) for farming – unlimited agricultural land area.

Regional Law No. 809-OD “On allotment of public and municipal land to citizens free of charge”.

This Law has been formulated in accordance with the Constitution for the purpose of stabilizing and perfecting the two-level operation system, which is based the responsibility system of contracting by households supplemented by unified management, entitling the peasants to a long-term and guaranteed right to the use of land, protecting the legal rights and interests of the parties of the contracting of rural land, so as to improve the development of agriculture and the rural economy and stabilize the rural areas.

Regional Law No. 276 “On gardening, vegetable growing and subsistence farming non-governmental entities”.

This Regional Law shall be applicable to all gardening, horticultural and subsistence farming non-commercial organizations, non-governmental entities and cooperatives. It regulates the issues of state registration of the aforesaid entities and establishes legal status thereof. Citizens shall be granted the right to carry our gardening, horticulture and subsistence farming either as cooperatives and associations or individually. Farmers must develop their land plots for agricultural purposes within three years since the date of allotment and ensure purposeful use of land plots.

Regional Law No. 69 “On food tax”.

This Regional Law establishes that all producers of agricultural commodities shall be subject to mandatory payment of single food tax. Objects of taxation shall be agricultural land held by the producers of agricultural commodities on condition of ownership, tenancy or lease. Food tax shall be paid in the natural form: (a) in grain by grain farming enterprises; (b) in poultry products by poultry farming enterprises; and (c) in natural products calculated as equivalent to a metric ton of grain by other enterprises producing agricultural commodities.
