La presente Ley establece el Régimen temporal extraordinario de formalización y titulación de predios urbanos informales, público o privados, disponiendo su preferente atención por parte de la Comisión de Formalización de la Propiedad Informal (COFOPRI).

Ley Nº 18.092 – Declara de interés general que los titulares del derecho de propiedad sobre los inmuebles rurales y las explotaciones agropecuarias sean los que se determinan.

La presente Ley declara de interés general que los titulares del derecho de propiedad sobre los inmuebles rurales y las explotaciones agropecuarias sean los siguientes: personas físicas, sociedades personales, sociedades agrarias, asociaciones agrarias, cooperativas agrarias, sociedades de fomento rural, personas públicas estatales y personas públicas no estatales. Asimismo, indica las condiciones en las que podrán ser titulares las sociedades anónimas y en comandita por acciones.

Article 25.2 of the Federal Law No. 122-FZ on state registration of immovable property and its transactions shall acquire a new wording: “The grounds for the state registration of the ownership right to a plot of land shall be: (a) deed on allotment of a plot of land; (b) land certificate attesting the right of citizen to a plot of land; (c) vidimus issued by the local self-government (if the plot of land has been allotted for subsidiary small-holding); (d) any other certificate attesting the right of citizen to a plot of land”. This Law establishes legal grounds and the modalities of state registration of immovable property and restrictions (encumbrances) imposed thereon, and also transactions on the national territory and state protection of registered rights and restrictions (encumbrances) imposed on immovable property and transactions therewith. This Law shall be applicable, inter alia, to state registration of the plots of land, plots of subsoil and forests (Art. 3).

This Presidential Decree establishes the modalities of preparation of documentation, registration and issuance of certificates for land plots allotted in ownership, tenancy and lease to natural persona, legal persons of Turkmenistan and foreign states, and also to foreign states and international organizations. Land plots can be conceded in ownership to Turkmenistan nationals for subsidiary smallholding in rural areas, and for individual housing construction in the towns and townships.

The aim of this Proclamation is to improve management and utilization of land and land resources for agricultural purposes. It applies to all land that lies outside of municipal borders. The Proclamation defines the right to acquire, free of charge, rural land by adult residents of the region, whose livelihood depends on agriculture, and other subjects. It also defines land use rights of peasants, pastoralists and semi-pastoralists and provides for the protection of such rights.

This Law regulates delimitation of public land and land pertaining to local self-government. The Act consists of 5 Sections divided into 11 articles: (1) general provisions; (2) public land; (3) land of local self-government; (4) transfer of the right of land ownership; (5) conclusive and transitional provisions. Public land shall be inalienable property, it shall not be subject to levy execution and time limitation of prescription, nor can it be used as property bond or purchased by third party. Public land can be only conceded in use, concession or lease.

This Act sets regulations on public and private fences to delimit property boundaries. The Act applies to the use of fence for delimitation of land and sets regulation on the type of fences permitted, make thereof (metal, electric, bush), agreed size of fences, their maintenance etc. The establishment of fences must be paid by both parties and should be in style of the building/construction belonging to it. Changes may occurr subject to pre-agreement on size and costs.

Federal Law No. 122-FZ on state registration of immovable property and its transactions shall be supplemented with item 7 granting the right to the beneficiary under will to register ownership right to a plot of land upon presentation of land ownership certificate to the aforesaid plot of land of the previous owner. In the Federal Law No. 66-FZ on farming, gardening, housing non-profit-making associations the wording “allotted plots of land for farming and gardening” shall be substituted with the wording “plots of land for farming and gardening granted in ownership.”

The purpose of this Law shall be to regulate relations in the sphere of setting up and functioning of condominiums as voluntary associations of citizens multi-family dwelling located of the plot of land pertaining to common property. State support of condominiums shall be exercised in the form of allotment of the plots of land in open-ended use. Construction on the plots of land pertaining to condominiums shall be carried out in accordance with legislation on land use planning.
