This Law establishes terms and conditions for ownership, use and disposal of state property and property of local self-government and, in particular, land, inland waters, parks and subsoil. The Act consists of 4 Sections divided into 24 articles: (1) general provisions; (2) purchase of state property and property of local self-government; (3) ownership, use and disposal of state property and property of local self-government; and (4) concession and writing off of state property and property of local self-government unfit for use.

The present Law lays down provisions relating to farming land and gardens. Article 1 establishes that a Farming Land Commission shall be nominated. Law No. 473-Ic on promoting and ensuring investment activity.

This Law establishes legal basis for carrying out either foreign or local investments end ensuring their protection. The purpose of the Law is to establish legal basis for promotion of investments. Investments are all types of property and intellectual values and rights invested and used in entrepreneurial activity on the territory of Georgia for the purpose of making profit. Such values can be land, land tenancy, the right to use natural resources (including concession) and licences.

Law on normative price and procedure of sale and purchase of land (No.1308-XII of 1997).

This shall be applied in the following cases of: a). sale and purchase of land, including land associated with privatized objects or objects subject to privatization, land associated with private enterprises, as well as of land associated with unfinished constructions; b) exclusion of land from agricultural and forestry category, as well as from the agricultural cycle and allocation of such land to other categories; c) forced alienation of land; d) lease relations. The document consists of VII Chapters that contain 25 Articles. Chapter I (arts. 1-2) lays down general provisions.

Law of 1997 on land fees.

The purpose of this Law is to charge citizens, business entities, and organizations with fees for possessing and/or using state-owned land, and to regulate the relations arising from paying the fees to the state budget. Land fees shall be charged for lands falling under the main classification of the unified land territory or special usage land specified in the Article 10 of the present Law and possessed or used by citizens, business entities, or organizations according to land possession and/or usage contracts. The document consists of 13 Articles.

Regional Law No.191-35 of 1998 on investments in immovable property of St.Petersburg.

This Law establishes the conditions and the modalities of realization on investment activity aimed at building of the plots of land, for completion of unfinished constructions, reconstruction of edifices, their parts belonging to St.Petersburg for the purpose of profiting when the result is creation of immovable property. Article 7 establishes that investment prospect must contain the obligation of a potential investor to pay the services of the preparation of urban construction and land surveying documentation.

Fiduciary transfer of property Act.

The Act establishes that the contract of fiduciary transfer of property on an immovable thing the debtor or a third party assumes the obligation to transfer the right of ownership to the creditor in order to secure discharges of claim and the creditor assumes the obligation, after settlement of his claim, to enable the debtor an undisturbed enjoyment of the right of ownership. The contract of fiduciary transfer of property must be concluded in written form, and in the case of immovable objects the contract must be authenticated by the court. The text consists of 30 Articles.

Law No. 94-1 on housing facilities.

This Law regulates relations regarding housing facilities, including plots of land pertaining to common property of condominiums. In case of demolition of residential building because of expropriation for public needs of the plot of land on which it was located the owner shall have the right to another residential space or compensation at his choice (art. 15). Transfer of residential space shall entail transfer of land ownership (land tenure) rights to a new owner (art. 19).

Settled Land Act.

This Act sets out rules for the sale, partition, lease, administration by trustees, mortgaging, exchange, etc. of settled land and certain rights related to the use of such land. The Act sets out criteria and definitions as to what land is considered settled land. It defines the right of a tenant for life in respect of such land including lease of land for mining purposes. The Act sets out certain rules applicable to mining leases.

Land (Title Deeds Restoration) Act.

This Act empowers the Registrar of Titles to issue new title deeds to property where such title deeds are deemed to be destroyed by disaster. The Act sets out the procedures for the restoration of title deeds.

Limitation and Prescription Act.

This Act concerns the validity of claims of prescription which may be lawfully made at common law or by custom to any way or other easement or to any watercourse or to the use of any water, to be enjoyed or derived upon, over or from any land or water. The Act, among other things, sets out criteria for the computation of the period after which a claim shall be held valid.
