These Regulations, made by the Minister of Forestry under section 13 of the Mountain Catchment Areas Act, implements provisions of that Act in respect of: the constitution and composition of Fire Protection Committees; the election of members of advisory committees for Mountain Catchment Areas; applications for financial aid; declaration of private land as Mountain Catchment Area and relative procedures; directions to owners of land in a Mountain Catchment Area; and applications for compensation of patrimonial loss.

The scope of the Act is to improve the living standards and opportunity of earning of those involved in agriculture, forestry, fishery and aquaculture, hunting, reindeer breeding and other nature-based activities in the Northern districts of Finland. These Regulations concern tree preservation orders which may be issued by local authorities under section 25 of the Town and Country Planning Act. The Regulations specify some procedural requirements and require the Minister to take into account objections and representations before confirming an order.

The Minister declares under section 21 of the Forest, Soil and Water Conservation Ordinance Protected Forests for purposes of protection against storms, winds, rolling stones, floods, landslides, prevention of soil erosion and the deposit of mud, stones, etc. on agricultural land, prevention of wastage of resources of timber and for securing the proper management of timber lands, the maintenance of water supplies in springs, rivers, canals and reservoirs, the protection of specified works, and the preservation of health.

The Minister declares under section 19 of the Forest, Soil and Water Conservation Ordinance Forest Reserves for purposes of protection against storms, winds, rolling stones, floods, landslides, prevention of soil erosion and the deposit of mud, stones, etc. on agricultural land, prevention of wastage of resources of timber and for securing the proper management of timber lands, the maintenance of water supplies in springs, rivers, canals and reservoirs, the protection of specified works, the preservation of health, and the protection of slopes over 35° of inclination.

Notification on the procedures of forest settlement in Bhutan.

The newly instituted Survey and Demarcation Division shall conduct the survey and definiton of boundaries of the so called reserved Forests of Bhutan and shall widely spread information about the forest areas included under this provision, in order to ascertain eventual claims of rights on forests and their products, land and water courses or grazing and pasture rights. The involved land shall be excluded from the reserved forest areas or expropriated or acquired.

The Governor may constitute Forest Reserves under section 4.A Notice in this respect shall be published in the Official Gazette. For each Reserve a Reserve Settlement Commissioner shall be appointed. Restrictions are placed on acquisition of rights during an interim period between publication and an Order constituting a Reserve under section 17. The Settlement Commission shall be considered a Court. The Commissioner may exclude land from a Reserve. Section 13 concerns compensation and section 14 concerns extinction of rights.

En lo sucesivo, el aprovechamiento de productos forestales que se realice en bosques de tal naturaleza sin permiso del Departamento de Tierras del Ministerio de la Economía Nacional, no constituye explotación lícita de los mismos y, en consecuencia, no confiere derechos, no da posesión de la tierra donde tales bosques se hallaron plantados, ni puede invocarse como fundamento para obtener las adjudicación de terrenos baldíos.

The President decrees, in accordance with the legislation currently in force, to introduce the differentiation of the state property on natural resources by designation of federal natural resources. Federal natural resources include land, water, forest, subsoil, wildlife species and plant variety of national importance.

The District Council may declare any area a prohibited or preserved (area). All areas listed in the First Schedule are hereby declared preserved areas (by-law 3). No person shall cultivate, cut any grass, or graze animals in any preserved area (by-law 4). The Council shall, after consultation with the Agricultural Officer, prescribe the type of agricultural or animal husbandry, the type of crops that may be planted and the steps taken to prevent soil erosion and to conserve water in a prescribed area (by-law 5).
