This Act defines powers and limits actions of trustees and other persons appointed in a will, deed or other instrument of settlement or mortgagees to lawfully dispose of land under their control pursuant to rights conferred upon them as trustees or mortgagees.The Act grants powers, subject to conditions a set forth in this Act, to trustees to sell or exchange land indicated in a will, deed or other instrument of settlement.

Registration of Condominium Titles Act (No. 8 of 1973).

This Act provides for land to be divided into condominium lots and for the registration of a condominium plan, the establishment of a corporation for purposes of administration of the common property, easements in relation with condominium, by-laws applying to condominium lots and common property and other matters relating to the administration of the common property and condominium lots.Land may be subdivided into condominium lots in accordance with a condominium plan, the contents of which are prescribed by this Act.

Small Tenements Act (No. 13 of 1891).

This Act makes provision for duties and proceedings in relation with the ending of a tenancy of a small tenement as defined in this Act.If a tenant does not leave the tenement after a notice of the landlord, the Magistrate may, on the application of the landlord, issue a summons in the form as set out in the Schedule to this Act. The Act specifies court proceedings in respect of a dispute, provides for compensation of improvements and declares the repossession of a tenement to be an offence.

Partition Act (No. 15 of 1895).

This Act sets out the conditions and procedures for the partition of land held by more than one tenant, i.e. joint tenants and tenants in common.Any person entitled to claim partition may apply to Court for partition, which shall, after issue of an order of partition by Court, take place in the matter as specified by this Act. The Court may also direct the sale of the property if it thinks to be more beneficial to the parties involved to distribute proceeds of the sale among them instead of carrying out the partition.

Land Settlement Act (No. 15 of 1939).

This Act makes provision for some aspects relating to the settlement on land. The Cabinet may, by Order, declare any area of Crown land to a settlement area. A settlement area shall be destined for the settlement of small agricultural holdings and the land allocated shall be subject to restrictions as to the disposal of the land and crops thereon. The Act further provides for regulation-making powers of the Cabinet.

National Council of the Supreme Soviet decrees that contracts concluded before entry into force of the Law on lease that envisage long-term lease of industrial sphere and services as well as redemption of leased property (except for contracts concluded by working collectives) can be disputed by owners or by their authorized representatives at the arbitration tribunal or people’s court.

This Act makes provision for the establishment of Tenancies and Rent Control Tribunals, provides for powers of such tribunals and provides rules relative to lease and the relationship between landlord and tenant.The Act declares the receiving of rent for premises that are not registered with a Tribunal in accordance with this Act to be an offence.

This Act directs the Registrar of Titles to make a new register of titles for Dominica. This Act applies only in cases where certificates of title which were registered in the old register have been destroyed. The Act contains rules relative to (application for) registration and evidence of title. The Act also provides for the lodging of caveats for the establishment of interests in land other than freehold and certain leaseholds.
