The present Law determines economic, legal and social basis of the organization and functioning of peasant associations. Peasant association is and autonomous economic entity with the status of legal person set up on voluntary basis by persons engaged in agricultural production. Peasant associations can be set up as state, cooperative, mixed and other forms of property (art. 1).

Lease represents fixed-date contractual charged possession of land and land tenure and possession of other natural resources (art. 1). Land and other natural resources can be granted on lease (art. 3). Rent shall include depreciation charges imposed on leasehold. Depreciation charges shall not be imposed on land leasehold (art. 8). Land lease shall be granted for long-term period - ten years and over (art. 12). The Law consists of 2 Sections composed of 33 articles.

This Act amends Act No. 109/88 on Agrarian Reform. It consists of amended articles defining new principles in order to manage this sector and promote agricultural development: land expropriation requirements, agricultural land use, land rights, land concession, land lease, land inheritance, protected zones, etc.

Act No. 68/93 concerning uncultivated lands.

This Act provides for the use of public uncultivated lands. It consists of 42 articles specifying the requirements to be met in order to exploit these lands, establishing the conditions for land expropriation, concession, use, etc. It lays down duties, competencies and composition of national administration responsible for the management of these lands, fees to be paid, land lease, etc.

Repealed by: Law No. 75/2017 establishing the regime on uncultivated lands and other community productive lands. (2017-08-17)

Landlord and Tenant Act (R.S.P.E.I. 1988, c. L-4).

This Act provides the legal framework for the relationship between landlords and tenants, it consists of 89 sections and is divided into four parts. Part I contains general provisions on leases, rents and covenants. Part II is dedicated to the distress for rent and related procedures. Part III concerns “ejectment proceedings liability of tenants overholding” and Part IV contains miscellaneous provisions.

The amendments include changes to provisions concerning damage to premises or amenities and the Common Amenities Board. Where the Commissioner directs the Common Amenities Board shall repair any damage to any premises or restore and repair any facility that was previously provided for the tenant.

The Act makes provision for the registration of title in land and related matters.
