Intestates' Estates and Property Charges Act.

This Act makes provision with respect to inheritance and in particular concerns the distribution and administration of estates of persons who leave a will but die intestate as to some beneficial interest in his real or personal estate. The Act sets out rules regarding rights of heirs. It also concerns statutory trusts for the purpose of inheritance.

Administrator-General’s Act.

This Act: makes provision for the appointment of the Administrator-General for Jamaica by the Governor-General; defines functions and powers of the Administrator-General and provides with respect to the functioning of the Administrator-General and relevant judicial and administrative procedures, especially in respect of the administration of estates. The Administrator-General shall apply for letters of administration relative to the estates of all persons who shall die intestate and without heirs.

Property (Transfer) Act.

This Act places restrictions on certain dispositions regarding any freehold or leasehold land. It requires partition, or exchange, or assignment of freehold or leasehold land or lease of freehold or leasehold land to be done by deed and provides for transfer of contingent or executory interest in land or other property. It also deals with powers and rights in case mortgage contracted by a deceased person.

This Act provides that real estate over which a person executes by will a general power of appointment, as if it were real estate vested in him, without a right in any other person to take by survivorship, shall on his death, notwithstanding any testamentary disposition, devolve to and become vested in his personal representative(s), as if it were a chattel real vesting in them or him.

This Act establishes periods of limitation and other limitations for bringing actions of the various classes mentioned in the Act. Section 42 extends the applicability of the Act also to arbitration. Actions include various actions in respect of land: actions to recover land by the Crown or any person and rent; action to recover money secured by a mortgage or charge or to recover proceeds of the sale of land; and actions in respect of trust property or the personal estate of deceased persons and actions for an account.

This Order, made under section 12 of the Public Trustee Act, specifies the fees shall be charged in respect of the duties of the Public Trustee, provides for the calculation of such fees and provides for settlement of disputes regarding the duty to pay fees. Fees that shall be charged in respect of the duties of the Public Trustee are: (a) an acceptance fee; (b) an administration fee; (c) a withdrawal fee; (d) fees for special services.

These Rules, made under section 29 of the Supreme Court Act, provide with respect to Probate and more in general to the administration of estates. The Rules deal with, among other things: application for Probate or Letters of Administration, or for sealing a Probate or Letters of Administration or other testamentary paper granted out of the jurisdiction; procedures regarding testamentary papers; and bonds after application is granted.

Immovable Property (Judicial Sales) Act (Cap. 94).

This Act concerns judicial sales of property including agricultural crop. It gives rules for the seizure and execution by way of sale. At any time, while the execution debtor remains in possession of the property seized, as judicial sequestrator, any creditor may obtain an order for the sale of part or of the whole of the crop of the said property. All sums of money which shall have been advanced by any sequestrator in accordance with the foregoing provisions shall be a privileged claim on the crop of the property.

Land Settlement (Perpetual Leases of State Land) Act (Cap. 108).

This Act provides for the grant by the Government of perpetual leases, i.e. leases of State land granted for the purposes of land settlement, which shall endure in perpetuity unless they lapse or are terminated or surrendered. Perpetual leases of State land may be granted for purposes of land settlement and shall be subject to terms and conditions stated in them and in provisions of this Act. Transfer, mortgage, etc. of a lease shall be subject to permission of the Government.
