The present Law establishes the form of land ownership, the base of origin, changes and cessation of land ownership, regulates the order of realization of the rights and the duties of landowners. The land relationship connected with privatisation of buildings, structures, and constructions belonging to state property are regulated by special acts related to land legislation. Land ownership in the Republic of Belarus is present in the forms of state and private ownership.

The purpose of this Directive is to provide for measures, procedures and guidance in order to prevent or reduce negative effects on the environment (particularly the pollution of surface water, groundwater, soil and air) and of the global environment (including the greenhouse effect) as well as any other risk to human health that might result from landfilling of waste. For the purposes of this Directive, “waste” shall mean any substance or object which is covered by Directive 75/442/EEC.

La présente loi fixe la procédure de l’immatriculation de la propriété foncière. Cette procédure consiste dans l’établissement et l’enregistrement d’un titre de propriété appelé titre foncier. Par ailleurs, en ce qui concerne toute terre non immatriculée (vacante et sans maître, à moins que ne soit rapportée la preuve du contraire), elle prévoit la constatation et régime des droits coutumiers par une commission dont la composition est fixée par décret.

This Act constitutes the legislative framework in matter of environmental protection within the State of Sabah. Part II of the Act is devoted to the setting up of the Environment Protection Council whose functions shall be to advise the State Government on matters relevant to the implementation of these provisions. On the other side, Part IV of the Act provides for the establishment of the Environment Protection Fund. Further provisions as regards public servants and administration competent in the environmental field are laid down in Part V.

The Act lays down provisions concerning regional planning activities as regards soil protection, control of land use and interventions for the conservation and transformation of soil. The provisions cover both agricultural and urban land. As regards agricultural land, the aims pursued are the safeguarding and improvement of the natural heritage as well as the rational and sustainable exploitation of natural resources. The Regions shall be responsible for planning in conjunction with the Communes and Mountain Communities.

“Land” here includes land covered with water and things affixed on land or growing on land (sect. 2). The Act shall apply to any area constituted as a Registration District by the Minister under section 5In each District a land registry shall be maintained in which information set out in section 6 shall be kept. Section 7 concerns appointment of land registration officers. There shall be one Registrar of Land appointed by the President. Powers of this officer are outlined in section 8.

The Law provides for all the activities related to mining and exploiting the mineral resources, be them gemstone (ruby, diamonds, opal, sapphire etc.), metallic mineral (iron, gold, silver, zinc, copper, aluminium etc.), industrial mineral (coal, asbestos, etc.) and stone (marble, limestone, quartz, granite etc.). Large scale-production is encouraged as the exportation of mineral products.

This Act is enacted to prevent soil and groundwater pollution, to ensure sustainable use of the land and groundwater resources, to improve the living environment, and to enhance public health. It consists of 8 Chapters divided into 51 articles. Article 2 gives definitions of the terms used in this Act, e.g. soil pollution, groundwater pollution, pollutants, polluter, soil pollution monitoring standards, etc. The Act establishes the prevention and redemption measures in Chapter two, the investigation and assessment measures in Chapter three, and the control measures in Chapter 4.
