This paper gives a brief overview of the existing UPFG laws and regulations and points out the issues that legislative bodies may have to consider with regard to UPFG. The objective of the paper is to give an overriding analysis of the relevant issues that need to be considered in order to analyze the legal and institutional aspects of UPFG. Taking UPFG into consideration, the legislation of several countries was assessed to illustrate the broad framework, the gaps, the overlaps and the positive examples of laws and regulations.

FAO (Food and Agriculture Organization of the United Nations) and other development partners are working together with countries to prepare Voluntary Guidelines that will provide practical guidance to states, civil society, the private sector, donors and development specialists on the responsible governance of tenure. By setting out principles and internationally accepted standards for responsible practices, the Voluntary Guidelines will provide a framework and point of reference that stakeholders can use when developing their own policies and actions.

The Food and Agriculture Organization of the United Nations and its partners will hold consultations on various issues relating to the voluntary guidelines on responsible governance of tenure of land and other natural resources. The voluntary guidelines aim to provide practical guidance for State governance bodies, civil society and the private sector. The voluntary guidelines will provide a basis, which interested parties can use when developing their strategies and activities.

Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. Sin embargo, su implementación en muchos casos ha sido errónea, ha sufrido retrasos o, incluso, se ha invertido.

Sin embargo, las disparidades de género en el acceso a la tierra siguen siendo notables en muchos países, con independencia de su nivel de desarrollo. La nueva base de datos de la FAO ayudará a comprender los factores que impiden que las mujeres tengan acceso a la tierra, con lo que permitirá asimismo diseñar políticas mejores para afrontar esta situación de manera eficaz.

En 1999, la FAO publiait la première version française du Thésaurus multilingue du foncier. Cette version avait surtout pour vocation d'être mise à l'épreuve du terrain, c'est-à-dire soumise aux critiques constructives tant des usagers à la recherche d'informations et d'éclairages nouveaux que des experts du foncier. En effet, sur le fond comme sur la forme, sont apparus un certain nombre de points forts mais aussi des lacunes, relevés depuis 1999 par l'équipe des rédacteurs et par de nombreux autres spécialistes du foncier.

The paper looks at land tenure in Mozambique, where ever since independence in 1975, property in land has been vested in the state, and despite the political and economic shift to a multiparty system and market economy, this underlying principle has remained in place: no land may be sold, mortgaged, or otherwise encumbered or alienated. Local traditional land management systems meanwhile have retained a robust role as the de facto land management system of Mozambique.

This case study looks at the land tenure in Namibia, where for a century of colonial rule indigenous Namibians were dispossessed from rights to both land and resources – by German and then white South African settlers establishing commercial farms and related businesses. Access to freehold tenure was reserved for white settlers and tenure security for indigenous Namibians largely disappeared. In non-white areas, rights were provided under indigenous tenure systems whose legal status was somewhat murky. Urban tenure was denied as blacks were not allowed ownership of residential land.
